PART 8: MAINTENANCE AND SERVICE<br />

(1) The removal or rendering inoperative by any person<br />

other than for maintenance, repair, or replacement, of any<br />

device or element of design incorporated into any new vehicle<br />

for the purpose of noise control prior to its sale or delivery<br />

to the ultimate purchaser or while it is in use, or (2)<br />

the operation of the vehicle <strong>after</strong> such device or element of<br />

design has been removed or rendered inoperative by any<br />

person.<br />

Among those acts presumed to constitute tampering are<br />

• Noise Insulating Blankets<br />

Removing noise insulators from engine block or from<br />

around the oil pan.<br />

Cutting holes in, or cutting away part of, noise insulators.<br />

Removing hood-mounted noise insulation.<br />

• Engine Electronic Control Unit (ECU)<br />

Modifying ECU parameters.<br />

• Engine Cooling System<br />

Removing or rendering inoperative the fan clutch.<br />

Tampering with Noise Control System Prohibited<br />

Removing the fan shroud.<br />

• Air Intake System<br />

Removing or rendering inoperative the air cleaner /<br />

silencers or intake piping.<br />

• Exhaust System<br />

Removing or rendering inoperative the exhaust system<br />

components.<br />

• Inner Fender Shields and Cab Skirts<br />

Removing shields or skirts.<br />

Cutting away parts of shields, skirts or damaged or<br />

loose portions of shields or skirts.<br />

• Fuel System<br />

Removing or rendering engine speed governor inoperative,<br />

allowing engine speed to exceed manufacturer’s<br />

specifications.<br />

Removing air signal attenuator on engines equipped<br />

with this device.<br />
