The victim Jishan Mahammed was aged 13 and was a student of IX standard. On 5 th May, 2008 he<br />
along with friends had sat in front of the Masjid. Usually the girls who passed that way had play tricks with<br />
them. Likewise, on the day of the incident, the girls had played tricks with them. So, the victim and his<br />
friends had also played with them.<br />
The girls had given a complaint against them that they passed comments. The police driver had gone<br />
to the spot and had dragged the victim Jishan Mahammed and had beaten him. The victim’s uncle had<br />
narrated the incident to the police and had freed the victim Jishan Mahammed.<br />

Summary of the case<br />
The victim Bhagirathi Sahoo (42) was a resident of Buxibazar, Cuttack. Two years back he had married<br />
Smt. Kuni Sahu. They lived happily together for some years, but then Kuni began abusing Bhagirathi<br />
mentally and physically by persuasion of their neighbour Akhaya Kumar Prusty, with whom she had an<br />
affair.<br />

On 30 March 2008 Kuni again troubled Bhagirathi by gathering some other women on in their home,<br />
even though he had requested her not to do that on that certain day. After some days, Kuni drove<br />
Bhagirathi out from their house and took Rs. 30,215/- from the house. She filed a false case of dowry<br />
torture against him at Mangalabag police station on 5 April 2008. The Officer-in-Charge of the police<br />
station appointed Assistant Sub-inspector (ASI) Smt. Durgasi Nandini Mohanty to enquire the case.<br />
Without lodging the F.I.R, the ASI called Bhagirathi over the phone and threatened him and told him to<br />
come to the police station. There, she verbally abused him and beat him without arresting him. While this<br />
took place, Kuni, Akhaya Prusty’s wife and other 4 to 5 women were present in the police station and they<br />
ridiculed Bhagirathi and laughed at him.<br />
After the incident Bhagirathi was forced by his wife to reside outside their house.
