Background and Summary of the case:<br />

The victim Krushna Chandra was a resident of Kumbharabasta village, Khurda. He worked as a<br />

service holder.<br />

On 3 April 2008, Prematala, who was the wife of police constable Sarbeswar Patra, filled an F.I.R<br />

against Krushna’s son Tapas Mangaraj in Khurda police station stating that had kidnapped her daughter.<br />

So on 4 April 2008 the Officer-in-Charge (OIC) and one other police officer of Khurda police came to<br />

Tapa’s house and when Tapas was not there, they forcibly took Krushna to the police station. He was<br />

detained until 11 PM.<br />

On the next day 5 April 2008 at about 9 AM, when Krushna was working in his office, he was again taken<br />

to the police station. When his wife and brother-in-law Bijoy Kumar Gumansing were informed of his<br />

arrest, they went to the police station together with some other villagers. The OIC of the police station<br />

would not release Krushna because Sarbeswar, whose wife had filed the F.I.R about the kidnapping,<br />

worked as constable at that police station. Sarbeswar threatened to kill Krushna, if he did not hand over<br />

his daughter to him. He also threatened to kill Tapas and send all his family members to jail.<br />

Sarbeswar and his sons also caused commotion with swords inside the premises of the police station<br />

during Khurda’s detention. In response to this the OIC threatened both Sarbeswar and Krushna to take<br />

them to Court. Then Sarbeswar begged to be excused by the OIC and said that the two families would<br />

together find their daughter and son. A written agreement about this was made at the police station.<br />

Then OIC released Krushna at about 6 PM on 6 of April. After Krushna returned home to the village,<br />

Sarbeswar again created disturbances and threatened to murder his family members and kidnap his<br />

daughter.<br />
