Agarwal lodged several complaints with the New Market PS (General Diaries Entries: G.D.E.<br />

No.-1900 dated 21-05-2005; G.D.E. No.-712 dated 08-<strong>03</strong>-2006; G.D.E. No.-2544 dated 26-08-<br />

2006; G.D.E. No-1259 dated 14-11-2006). However, the police were unwilling to take any steps<br />

to address those complaints.<br />

Agarwal then filed a complaint at the Court of the Chief Metropolitan Magistrate, Kolkata, under s.<br />

156(2) Cr. P.C. and ss. 406, 498A, 511, and 534 IPC (cruelty, criminal breach of trust, etc.). No<br />

action was taken.<br />

M. Sarkar, the female IO of the New Market PS, stated that she could not deal with Pista Devi<br />

Agarwal’s case due to her busy schedule.<br />

Case Details:<br />

Victim Prabhat Mallick and his family (the other victims) ran a grocery shop.<br />

In March 2001, a group of miscreants (including Gopal Bose, Hira Tiwary, Manik Bose, and<br />

Nilratan Bose) demanded that the Mallick family let them establish a club room on their land.<br />

When the family refused, the miscreants harassed and threatened them. When the family filed<br />

a complaint at the Howrah Court, the police did nothing.<br />

On 23 March 2001, the miscreants ransacked the Mallick family’s grocery shop.<br />

Prabhat Mallick lodged criminal and civil cases at the Howrah Court (No. 57/2001). The<br />

criminal case is still pending at the Kolkata High Court. In the civil case, the Civil Judge of<br />

Howrah Junior Division 6 th Court passed an order on 30 March 2007 that the property in<br />

question belonged to Prabhat Mallick and his family, and that none had the right to harass them<br />

about it.<br />

On 26 April 2007 at around 4.30pm, the miscreants violated the order by beating Ashish Mallick.<br />

Ashish was hospitalised at the T.L. Jaiswal Hospital, Howrah.<br />
