Victim Debnarayan Haldar, age 28, lives with his parents in Dayapur Village, Gosaba District.<br />
They are members of the Scheduled Caste community. Debnarayan Haldar’s family had a<br />
conflict with their neighbour, Nityananda Mondal, regarding some land.<br />
On 20 August 2007 at 8.00am, Nityananda Mondal’s brother Pintu Mondal trespassed onto<br />
Debnarayan Haldar’s family’s agricultural land and beat Debnarayan Haldar’s father Krishnapada<br />
Haldar almost to death. Some nearby farmers notified Debnarayan Haldar, who came to<br />
rescue his father. When he arrived, Nitayanda Mondal hit him with a spade on his back and then<br />
bit his upper lip. Debnarayan Haldar went unconscious.<br />
When Debnarayan Haldar’s wife arrived to rescue him, Nityananda and Pintu Mondal molested<br />
her.<br />
Some neighbours took Debnarayan Haldar to Gosaba PS to lodge a complaint, but the officers<br />
there only filed a General Diary Entry.<br />
The neighbours had Debnarayan Haldar admitted to the Gosaba Hospital, where he underwent<br />
treatment for six days.<br />
On 27 August 2007, Debnarayan Haldar was transferred to Bangur State Hospital for better<br />
treatment.<br />
On 28 August 2007, Debnarayan Haldar lodged a written complaint by post with the Gosaba PS,<br />
but the police ignored his complaint.<br />
Debnarayan Haldar also lodged complaints with the Superintendent of Police (South 24 Parganas)<br />
and the SHRC. No action was taken.<br />
On 30 August 2007, Debnarayan Haldar filed a case against the perpetrators in the Court of<br />
Learned Additional Chief Judicial Magistrate, Alipore u/s 148/447/448/323/325/326/506(II)/34<br />
IPC and 156(3) Cr.P.C. The officers of Gosaba PS did not take any legal action and took a stand<br />
strongly in favour of Nityananda and Pintu Mondal because the latter were influential.<br />
