Case Details:
Victim Jibanratan Sarkar, age 55, secured several judicial rulings in his favor, which ordered
cadres of the ruling party and employees of a ward Councilor not to drain from Sarkar’s land.
The Officer-In-Charge of Dashnagar I.C. was aware of these judicial rulings.
On 12 October 2006, the Officer-In-Charge of Dashnagar I.C met with the individuals who had
been draining from Sarkar’s property. Later in the day, after the meeting, the same individuals
(hereinafter, “attackers”) severely beat Sarkar and his wife with a rod and iron stick. Both Sarkar
and his wife were rendered unconscious. The attackers also destroyed their property.

Sarkar filed a case against the attackers (case no. 170/06 dated 12.10.2006 U/S 448/325/307/
427/379/506/34 IPC). However, no arrests have been made. Sarkar and his wife continue to
feel insecure in their home. Sarkar continues to struggle from mental trauma as a result of the
attack and sometimes talks incoherently.
