Case Details:<br />

Victim Jibanratan Sarkar, age 55, secured several judicial rulings in his favor, which ordered<br />

cadres of the ruling party and employees of a ward Councilor not to drain from Sarkar’s land.<br />

The Officer-In-Charge of Dashnagar I.C. was aware of these judicial rulings.<br />

On 12 October 2006, the Officer-In-Charge of Dashnagar I.C met with the individuals who had<br />

been draining from Sarkar’s property. Later in the day, after the meeting, the same individuals<br />

(hereinafter, “attackers”) severely beat Sarkar and his wife with a rod and iron stick. Both Sarkar<br />

and his wife were rendered unconscious. The attackers also destroyed their property.<br />

Sarkar filed a case against the attackers (case no. 170/06 dated 12.10.2006 U/S 448/325/307/<br />

427/379/506/34 IPC). However, no arrests have been made. Sarkar and his wife continue to<br />

feel insecure in their home. Sarkar continues to struggle from mental trauma as a result of the<br />

attack and sometimes talks incoherently.<br />
