The Court of the CJM remanded Bajlur Rahman to judicial custody until 14 September 2006. Bajlur Rahman had filed a written complaint regarding the manner in which he was arrested and beaten in custody, and in which he was not produced before a court within twenty-four hours of his arrest – but the Magistrate did not care. His family falls under the BPL list. On 12 th July 2007, Abdul Kader’s son Mirkasim went to the Seikhpara Bazaar to repair his torch. There, Mirkasim gave his torch to one Afjal Seikh for repair. Later, Afjal Seikh tried to give Mirkasim an old torch instead of his own torch. A scuffle arose. Afjal Seikh started beating Mirkasim in front of his shop. Abdul Kader rushed to the Bazaar to rescue Mirkasim, but Afjal Seikh beat him as well. Then Afjal Seikh forcibly confined Abdul Kader in the shop. The incident was witnessed by the local people. OC Purnachandra Ghosh of Raninagar PS arrived and arrested Abdul Kader. The police implicated Abdul Kader in an old criminal case (Raninagar PS Case No. 94/2007, dated 22.05.2007) u/s 147/148/149/186/353/307 IPC. This case was unrelated to the incident in the Bazaar. 422 local people filed a mass petition complaining against the police of Raninagar PS for their implication of Abdul Kader in the false case.

On 4 June 2007, Gazi was away on business. While he was away, Gazi’s aunt poured kerosene over her own body and shouted accusations that Gazi intended to set her on fire. Gazi’s aunt then lodged a complaint to that effect with the Swarup Nagar PS. When the police investigated the complaint, they did not take any statements of witnesses, including Gazi’s wife who observed the Gazi’s aunt’s actions and attempted to explain that Gazi was not present during the incident. Instead, they took statements from people who lived far away and were not present at the time. The police of Swarup Nagar PS initiated a criminal case against Gazi.
