On 17 March 2007, police from Beldanga led by OC Sandip Sen and SI Durgaprasad Mazumdar entered Hayat Seikh’s house and beat him in presence of his aged father. Hayat Seikh was taken into custody and detained for six days, during which he was continuously subjected to custodial torture. The police beat him with lathis on his palms, feet, and back, and he was also electrocuted. Hayat Seikh was produced before the Court with a charge u/s 107/ 116 Cr.P.C. (breach of peace in the locality). West Bengal 210 On 23 March 2007., Hayat Seikh was produced before the Sub Divisional Executive Magistrat’s Court. He was released under order of the Executive Magistrate. Hayat Seikh became ill and was admitted to the Belgdanga Gramin Hospital. On 25 March 2007, Hayat Seikh’s health reached critical condition. On 29 March 2007, Hayat Seikh was referred to Barhampur Hospital, but he collapsed before he could reach there. Hayat Seikh died. Hayat Seikh’s wife and relatives went to the Beldanga PS to lodge a complaint against the OC, but the police insulted them. When the public learned of the police officers’ behaviour, they surrounded the police station and protested. In response, DSP Shahabul Hussein ordered a post-mortem examination. However, when the examination report was completed the next day, the DSP woud not give Hayat Seikh’s family any information, but insisted that the police were not responsible for Hayat Seikh’s death. Dr. Ananda Mondal of the Barhampur Hospital has refused to divulge any information, referring all enquiries to the DSP. He allegedly stated in the post-mortem report that Hayat Seikh died of jaundice. Annual Report on Torture 2007 On 5 April 2007, Hayat Seikh’s widow filed a private complaint before the Chief Judicial Magistrate, Baharampur, u/s 200 Cr.P.C. against OC Sandip Sen and SI Durgaprasad Mazumdar, u/s 452/342/302/34/506/34 and 324/34 IPC. The witnesses to this case, all residence of Mahyampur under Beldanga PS, are Jamal Seikh, Ahan Seikh, Sabur Seikh, and Mehboob Rahman.

There, BSF POs from 10 Point Camp caught Ajbar and accused him of cattle smuggling. The BSF officers tortured Ajbar, kicking him and beating him with bamboo sticks. The BSF officers forced Ajbar to lie on the ground, and then they jumped on him. When he lost consciousness, the BSF officers poured hot water on him to wake him up. They then resumed torturing him in the same manner. After the assault, Ajbar began urinating blood. Ajbar was taken to the hospital on condition that he will not reveal the torture meted to him. He was taken to the Singhpara head Quarter of BSF and later to Jalangi Customs Office. Though the signs of torture were visible, out of fear of the police, he lied and stated he was not tortured. The BSF officers forced Ajbar to sign a paper stating that he was not tortured. A case was registered against Ajbar at the Jalangi PS for a petty case.
