On 17 March 2007, police from Beldanga led by OC Sandip Sen and SI Durgaprasad<br />

Mazumdar entered Hayat Seikh’s house and beat him in presence of his aged father. Hayat<br />

Seikh was taken into custody and detained for six days, during which he was continuously<br />

subjected to custodial torture. The police beat him with lathis on his palms, feet, and back, and<br />

he was also electrocuted. Hayat Seikh was produced before the Court with a charge u/s 107/<br />

116 Cr.P.C. (breach of peace in the locality).<br />

On 23 March 2007., Hayat Seikh was produced before the Sub Divisional Executive Magistrat’s<br />

Court. He was released under order of the Executive Magistrate.<br />

Hayat Seikh became ill and was admitted to the Belgdanga Gramin Hospital.<br />

On 25 March 2007, Hayat Seikh’s health reached critical condition.<br />

On 29 March 2007, Hayat Seikh was referred to Barhampur Hospital, but he collapsed before<br />

he could reach there. Hayat Seikh died.<br />

Hayat Seikh’s wife and relatives went to the Beldanga PS to lodge a complaint against the OC,<br />

but the police insulted them.<br />

When the public learned of the police officers’ behaviour, they surrounded the police station and<br />

protested. In response, DSP Shahabul Hussein ordered a post-mortem examination. However,<br />

when the examination report was completed the next day, the DSP woud not give Hayat<br />

Seikh’s family any information, but insisted that the police were not responsible for Hayat<br />

Seikh’s death.<br />

Dr. Ananda Mondal of the Barhampur Hospital has refused to divulge any information, referring<br />

all enquiries to the DSP. He allegedly stated in the post-mortem report that Hayat Seikh died of<br />

jaundice.<br />

Annual <strong>Report</strong> on Torture<br />

2007<br />

On 5 April 2007, Hayat Seikh’s widow filed a private complaint before the Chief Judicial Magistrate,<br />

Baharampur, u/s 200 Cr.P.C. against OC Sandip Sen and SI Durgaprasad Mazumdar, u/s<br />

452/342/302/34/506/34 and 324/34 IPC.<br />

The witnesses to this case, all residence of Mahyampur under Beldanga PS, are Jamal<br />

Seikh, Ahan Seikh, Sabur Seikh, and Mehboob Rahman.
