He was the only bread-winner of his poor family. As his business was flourishing, agents of the local PS used to collect Rs. 100 per month from him; the agents later demanded a hike in the amount. On 31 January 2007, the police arrested Giasuddin Mondal on an accusation of theft of electric wires. Giasuddin Mondal spent almost seven days in prison. On 2 August 2007 at about 7.30pm, SI Ayub Ali of Deganga PS, along with four or five police personnel, came to Giasuddin Mondal’s shop and arrested him. His little son hugged him with fear but those policemen pushed his son aside and brought Giasuddin Mondal to the station. At the station, PI Julfikaqr Ali Mollah tortured Giasuddin Mondal in an inhuman and brutal manner. The PI forced Giasuddin Mondal to put his head on a table while he fully sprayed acid into his rectum. This method of torture wreaked havoc with Giasuddin Mondal’s health: his rectum swelled greatly and he bled profusely from his anus. Annual Report on Torture 2007 On 4 August 2007, Giasuddin Mondal was sent to Biswanathpur Hospital for a medical checkup, but the casual examination revealed nothing. Giasuddin Mondal was produced before Court of the Magistrate at Barasat after twenty-four hours of detention. There, Giasuddin Mondal was implicated in a police case (Deganga PS Case No. 154, dated 04.08.07) u/s 399/402 IPC r/w 25(1)/(a) 127 of the Arms Act, for preparing to commit dacoity and assembling for such purpose, and for illegal possession of fire arms. The Magistrate ordered Giasuddin Mondal remanded until 13 August 2007, and ordered Giasuddin Mondal to receive treatment at the Jail Hospital. While Giasuddin Mondal was in the Jail Hospital, he learned that the police had also implicated him in two other cases: Deganga PS Case No. 57, dated 17.03.07 u/s 147/148/149/323/506/
436 IPC for rioting, committing hurt, criminal intimidation, and other charges; and Deganga PS Case No. 58, dated 17.03.07 u/s 147/148/149/323/342/436/379/506/325/34 IPC. On 13 August 2007, the Jail Authority sent Giasuddin Mondal to R.G. Kar Medical College and Hospital because his condition became critical as he was bleeding and crippled with pain. He was operated on at 12.00am; after his operation he returned to the Jail. On 3 October 2007, Giasuddin Mondal was granted bail. He was released the next day. After his release, Giasuddin Mondal’s physical condition became very bad: he was almost maimed and he was unable to resume his normal activity. The Committee of Protection of Democratic Rights took up Giasuddin Mondal’s case and organised a protest meeting with the local people against police torture. The Committee as well as Giasuddin Mondal himself lodged a complaint with State Human Rights Commission on 29 August 2007. Complaints were also sent to the Chairman of the NHRC, the District Magistrate of North 24 Parganas, the SP of North 24 Parganas, the Principal Secretary of the Home Department (West Bengal), the Chief Secretary of West Bengal, and the Governor of West Bengal. West Bengal 209 Giasuddin Mondal received only one acknowledgement letter, from the office of the NHRC and dated 16.10.2007. He received no other replies from the State administration vis-à-vis his search for justice against those who abused him.
