Early the next day, Mr. Mondal went to Domkal PS to lodge a written complaint against Tiarul and Saihidul Islam. There, Officer In-charge Sri Primashish Chattaraj, SI Khudiram Babu and SI Saokat Saikh claimed that the complaint was fake, used derogatory language and threatened to arrest Mr. Mondal for creating unnecessary problems. Within two days, the police called local Gram Panchayat Nurabul Islam and asked him to resolve the matter before Tiarul and Saihidul and their guardians. Several days later, Nurabul Islam spoke to the guardians. However, they refused to take any action against their sons. On 20 January 2005, Prabir Mitra along with some local antisocial, members of the local club “Maha Jagrata Sangha” criminally trespassed into Rekha’s house and demanded the key to the other flat. When Ashoke refused to give them the key, they locked him in a room and beat him with rods, kicks and their fists. Rekha Banerjee and Ajit Kumar Mitra also were injured when they attempted to help Ashoke. Ashoke fell unconscious from the attack. The perpetrators then left, but threatened to return. Rekha took Ashoke to the hospital. Rekha was forced to tell the hospital that Ashoke suffered a head injury when he fell in the bathroom. On 21 January 2005, Ashoke died in the hospital. The Hospital Authority released the body without making any post mortem and Rekha did not receive a death certificate.
On 21 January 2005 Rekha and her nephew lodged a complaint at Behala PS. Thereafter, she visited the PI several times to request that the PI investigate the matter and to inform him that Prabir Mitra and others regularly threatened her to withdraw the complaint. On 24 February 2005 Rekha filed a complaint to the SP of South 24 Parganas. Then, having no alternative, Rekha put the matter before the Hon’ble High Court and registered dated under section 304/34 of IPC against Prabir Mitra and others, on 24 September 2005. The POs arrested Shubhas and Apai. But after 15 days, they were released on bail. On 28 October 2005 investigating officer Uttam Banerjee and Behala SI locked victims in a cell and forced them to provide signatures for two letters, which were written by the police. On 7 July 2006 Rekha lodge a written complaint at Behala PS. Investigating officer Uttam Banerjee and Behala SI told Rekha not to bring the matter to media or press and suggested she close the matter. However, the Chanditala PS police officers only arrested those attackers who surrendered themselves to the police.
