Early the next day, Mr. Mondal went to Domkal PS to lodge a written complaint against Tiarul<br />

and Saihidul Islam. There, Officer In-charge Sri Primashish Chattaraj, SI Khudiram Babu and<br />

SI Saokat Saikh claimed that the complaint was fake, used derogatory language and threatened<br />

to arrest Mr. Mondal for creating unnecessary problems.<br />

Within two days, the police called local Gram Panchayat Nurabul Islam and asked him to<br />

resolve the matter before Tiarul and Saihidul and their guardians. Several days later, Nurabul<br />

Islam spoke to the guardians. However, they refused to take any action against their sons.<br />

Since then Mr. Mondal lodged several complaints against Tiarul and Saihidul Islam but the<br />

police refuse to take any action against them; one officer even fined Mr. Mondal RS 500.<br />

Jilal Mondal also lodged complaint to Sub-Divisional Police Officer named Sri Snehashish<br />

Dirghangi on 15 September 2006 to the SP, but they have not taken any action.<br />

Case Details:<br />

The victim Smt. Rekha Banerjee owned two flats. After the death of her husband, her brothers<br />

Mr. Ajit Kumat Mitra and Mr. Ashoke Kumar Mitra started living with her and appointed a<br />

caretaker, Mr. Prabir Mitra, for the second flat.<br />

2007<br />

Mr. Prabir Mitra started indulging in unlawful activities inside the flat. As a result, the society<br />

members of the flat requested that Prabir Mitra leave. On 20 January 2005, Prabir Mitra along<br />

with some local antisocial, members of the local club “Maha Jagrata Sangha” criminally<br />

trespassed into Rekha’s house and demanded the key to the other flat. When Ashoke refused<br />

to give them the key, they locked him in a room and beat him with rods, kicks and their fists.<br />

Rekha Banerjee and Ajit Kumar Mitra also were injured when they attempted to help Ashoke.<br />

Ashoke fell unconscious from the attack. The perpetrators then left, but threatened to return.<br />

Rekha took Ashoke to the hospital. Rekha was forced to tell the hospital that Ashoke suffered a<br />

head injury when he fell in the bathroom. On 21 January 2005, Ashoke died in the hospital. The<br />

Hospital Authority released the body without making any post mortem and Rekha did not<br />

receive a death certificate.
