Khan, OC 2) Samar Kanti Bhowmik, IO Location : Namkhana PS, Bakkhali Date of incident : 16/12/2007 Case Details: The above mentioned victims are fishermen residing in Bangladesh. On 15 th December 2007 they went across the sea with their rented trolleys from Koksh Bazar Port to catch fish. After some time the trolley crossed the Indian border, and coasted to the bank of the sea near Bakkhali. Few local people of that area snatched all the fishes. The news was informed to Mr. Tejen Das, Secretary of Kakdip Fisher Association, who in turn made a complaint to the Sub- Divisional Police Officer of Kakdip. Accordingly the victims were arrested by the OC and IO of Namkhana Police Station on 16 th December 2007. They were detained under illegal custody for two days, following which they were produced before the Court. They had a mobile and a cash of Rs.85 which was seized by the police without any mention in the seizure list. On 28 th December 2007 Mr. B.R. Khan and Mr. Samar Kanti Bhowmik were summoned to Kakdip Court as per the order of the Additional Chief Judicial Magistrate but both of them didn’t present themselves. NO. – 81 Victim(s) : Amitava Dutta Perpetrator(s) : 1) OIC 2) Swapan Chakraborty, SI 3) Police Driver 4) Police 5) Rabibabu, IO Location : Naogar More, Serampore Date of incident : 27/05/2008 Case Details: Victim Amitava Dutta, aged 31, is a resident of Bibiber village, falling under the jurisdiction of Serampore Police Station. On 27 th May 2008 the victim and his wife were returning home after medical check-up of his pregnant wife Mousumi Dutta. On the way they were stopped by the SI, and few policemen of Serampore Police Station, demanding the license and other documents pertaining to the motor bike. Amitava had bought the bike from Bappa, whose license he possessed. When he showed the same the driver struck the victim, causing injuries on his right hand. The SI ordered Bappa to be brought to the place. Amitava rushed and brought Bappa to find nobody in the place of the incident. On 31 st May 2008 few officials of Serampore Police Station barged into the house of the victim and carried away the TV and VCD Player. items but the officer demanded Amitava to surrender. The victim surrendered before the ACJM Court, Serampore on 26 th June 2008. A petition was also filed before the ACJM, Serampore the same day claiming return of the seized items. On 2 nd July 2008 once again police officials broke open the lock of victim’s house and carried away the Election Identity Card, Ration Card and a cash of Rs.800. Amitava then approached the members of Trinamul Congress Party (TMC). Mousumi also lodged a complaint to the SDPO. The police on the other hand state that the victim is an anti-social person and had assaulted the police. In fact Amitava was injured on his right hand and the doctor advised him to take an X-Ray. No. 106 Victim(s) : Anup Debnath Perpetrator(s) : 1) Sital Singh, HC 2) PCs Location : Gobindapur Border Out-Post, North 24 Parganas Date of incident : 31/12/2007 Case Details: Victim Anup Debnath is an agricultural labour residing in Purbapalta village, falling under the jurisdiction of Swarupnagar Police Station. On 31 st December 2007 seven constables knocked the house of the victim and pounced upon him the moment the door was opened. Anup was subjected to several beatings, dragged to the police jeep and taken to Gobindapur Border Out-Post. He was taken to several places, and when his eyes were untied he witnessed few panchayat members with whom the BSF Officials were negotiating. Anup also witnessed Basudeb Sarkar being alleged of engaging in smuggling of cattle. After some times the victim heard the sound of firing and within few minutes Basudeb was brought inside the camp dead. Following this incident, Anup was send to Swarupnagar Police Station being registered under a case, alleging him of causing hurt to a public servant, attempt to murder, and theft. He was produced before Basirhat Court from where he managed to get bail. The victim’s husband went to Bangladesh and never returned. She has a 18 year old daughter who is married. Sahajamal Seikh brought some flour for Sobebarat festival, and gave it to his wife Layla Bibi. Layla forgot to store the flour in a container, the result of which a dog ate up everything.
