Case Details:<br />

The above mentioned victims are fishermen residing in Bangladesh. On 15 th December 2007 they went<br />

across the sea with their rented trolleys from Koksh Bazar Port to catch fish. After some time the trolley<br />

crossed the Indian border, and coasted to the bank of the sea near Bakkhali. Few local people of that<br />

area snatched all the fishes. The news was informed to Mr. Tejen Das, Secretary of Kakdip Fisher<br />

Association, who in turn made a complaint to the Sub- Divisional Police Officer of Kakdip. Accordingly<br />

the victims were arrested by the OC and IO of Namkhana Police Station on 16 th December 2007. They<br />

were detained under illegal custody for two days, following which they were produced before the Court.<br />

They had a mobile and a cash of Rs.85 which was seized by the police without any mention in the<br />

seizure list. On 28 th December 2007 Mr. B.R. Khan and Mr. Samar Kanti Bhowmik were summoned<br />

to Kakdip Court as per the order of the Additional Chief Judicial Magistrate but both of them didn’t present<br />

themselves. All the victims come from a poor economic background and have no other means of<br />

sustenance.<br />

Case Details:<br />

Victim Amitava Dutta, aged 31, is a resident of Bibiber village, falling under the jurisdiction of Serampore<br />

Police Station. On 27 th May 2008 the victim and his wife were returning home after medical check-up of<br />

his pregnant wife Mousumi Dutta. On the way they were stopped by the SI, and few policemen of<br />

Serampore Police Station, demanding the license and other documents pertaining to the motor bike.<br />

Amitava had bought the bike from Bappa, whose license he possessed. When he showed the same the<br />

driver struck the victim, causing injuries on his right hand. The SI ordered Bappa to be brought to the<br />

place. Amitava rushed and brought Bappa to find nobody in the place of the incident. On 31 st May 2008<br />

few officials of Serampore Police Station barged into the house of the victim and carried away the TV and<br />

VCD Player. Mousumi went to Serampore Police Station and pleaded with the IO to get back the stolen<br />
