Police were repeatedly harassing Samir, demanding dowry. A team named P.C.Party was working under this police station, which often visited the site and called the victim aside to get money from his hands. Laltu Tiwari was one such anti-social person of the party who often threatened Samir. On 25 th February 2008 the IIC demanded Rs.2,00,000 from the victim which Samir refused, owing to which the project work was stopped from progressing. On 26 th February 2008, while the victim had gone to the Canara Bank ATM Center he was arrested by the Thakurpukur Police. At the station the IIC forced the victim to visit the station regularly like other promoters. The police also persuaded the owner of the land Dipika to file a false case against Samir. He was put inside the lock-up and a cash of Rs.10,000, mobile, ATM Card, and wrist watch were taken away from him. On 27 th February 2008 his articles were returned and he was produced before the Ld. Additional Chief Judicial Magistrate at Alipore, being implicated under Arms Act. There were contradictions in the FIR filed, for the place of arrest was not mentioned in it. The court ordered the police to remand the victim in police custody till 1 st March 2008. On 6 th March 2008 Lalbazar Police department took Samir under their custody, and he was produced before Bankshal court, following which he was ordered to be kept under police custody till 13 th March 2008. The victim was found innocent of all the charges after investigation and he was granted bail on 13 th March 2008, under the condition of signing daily in the police station. During this time he was regularly threatened by the police officials to compromise with them. Samir also came to know that he would be falsely implicated in a case of smuggling drugs. The matter was informed to the SP, DIG and CM via post on 7 th March 2008. Khan, SI Location : Garden Reach PS, Kolkata Date of incident : 06/04/2008 Case Details: Victim Sanjoy Singh, aged 40, is the Chairman of Royal Cruiser Company, which his located at Tartala road. On 6 th April 2008, a police constable of Garden Reach Police Station came to the company and demanded bribe from the hands of Akbar Khan, the driver of the company. The latter was beaten up brutally for denying the same. Sanjoy and Dhananjoy Singh, the MD of the Company along with few other staff went to Garden Reach Police Station to lodge a complaint against the constable, but the latter went ahead and lodged a false complaint against Sanjoy showing injuries on his head. Thus the victim was beaten up by the SI and other police officials, the result of which he sustained injuries on his nose, left arm and face, oozing out blood. The victims were detained the whole night under illegal custody and in the following morning they were granted Police Station Bail. But they were produced before the Chief Judicial Magistrate of Alipore Court on 7 th April 2008. The Court first rejected the bail but accepted the second one. During these times, the police didn’t make arrangements for administering treatment for Sanjoy, who were severely injured. Dhananjoy send complaints to the CM, Transport Minister, Home Secretary, Police Commissioners, DCP, SP, OIC of Rabindranagar Police Station and OIC of Garden Reach Police Station but in vain. For the past one and a half years the victim was fighting for the miserable health condition of the people in the locality. He also ran a non-political organization namely ‘Janachetana Mancha’ which worked for the people to uphold their fundamental rights. On 12 th April 2008 while Santanu was taking tea in a shop at Itachuna village, few people including the above mentioned perpetrators leaped upon the victim and beat him up brutally using bamboo sticks and iron rod. Santanu fell unconscious and he was hospitalized by the local people. At night the people of the locality went to Pandua Police Station for filing a case against the perpetrators, but the OIC denied receiving the written complaint given by the victim with his signature. Finally the people resorted to protest following which the case was registered. Eight names were mentioned in the complaint letter, but till date the police haven’t taken any actions against them for they were supporters of the ruling CPI(M) Party. The victim received treatment for three days. Earlier Santanu was arrested on 13 th September 2007 and detained along with a tribal woman for six hours in a police van. Thus the victim is always a target for the police. On 31 st March 2008 the victim was brutally beaten up by the Superintendent of the Correctional Home. Subrata and many other prisoners in the home were tortured with blades, sticks and rods. Subrata sustained severe injuries on his back and right hand. They were also threatened at gun point.
