Victim Mahender Das was assaulted by a traffic sergeant on 7 th December 2007, within the jurisdiction<br />
of Hare Street Police Station. He was struck on his face causing injuries, which had to be sutured. After<br />
lot of persuasion Hare Street Police Station registered the compliant under the protest from different<br />
authorities and the media. But the police were negligent about the case and didn’t take any action against<br />
the perpetrator, giving the reason that the name of the accused was anonymous. Complaints were also<br />
made before higher authorities. The DCP of Traffic Department, Kolkata issued a notice dated 26 th<br />
February 2008 directing Hare Street Police Station to take the case seriously. But the police were still<br />
negligent. In the name of inquiry Mahender was frequently summoned to various places and harassed.<br />

Case Details:<br />
Victim Mantu Mondal, aged 35, is a resident of Bangladesh. On 14 th February 2008 the victim came<br />
into India through the Indo-Bangladesh border near Kashipur Kuler Camp. He was a daily labourer and<br />
his family condition is very poor. The victim came to visit his sick maternal uncle Isahaq Mullick. The<br />
BSF Officials arrested him on the way to India, beat him with sticks and rifles, and detained him in the<br />
camp. Mantu’s left hand was fractured and the victim also sustained injuries all over his body. On 15 th<br />
February 2008 the officials handed Mantu over to Bagdah Police Station, who in turn produced him<br />
before Bongaon Court the next day. He was send to the hospital owing to his bad health. At the hospital<br />
the police cuffed his legs to the bed. On 26 th February 2008 Mantu was discharged and on 14 th March<br />
2008 he was transferred to Dumdum Central Jail. Till 17 th march 2008 the family of the victim was not<br />
informed regarding the arrest. After inquiry it came to light that the victim had no legal documents to enter<br />
into India, and the FIR revealed the fact that he was actively involved in border crime and smuggling.<br />
