FF Code : W.B./ MON(Aditi Kar)/ District- Kolkata/ Mar-22/03/2008/Sl.No.-118 Victim(s) : Mahender Das Perpetrator(s) : Traffic Police s Location : Kalighat, Kolkata Date of incident : 07/12/2007 Case Details: Victim Mahender Das was assaulted by a traffic sergeant on 7 th December 2007, within the jurisdiction of Hare Street Police Station. He was struck on his face causing injuries, which had to be sutured. After lot of persuasion Hare Street Police Station registered the compliant under the protest from different authorities and the media. But the police were negligent about the case and didn’t take any action against the perpetrator, giving the reason that the name of the accused was anonymous. Complaints were also made before higher authorities. The DCP of Traffic Department, Kolkata issued a notice dated 26 th February 2008 directing Hare Street Police Station to take the case seriously. But the police were still negligent. In the name of inquiry Mahender was frequently summoned to various places and harassed. West Bengal 455 FF Code : W.B. / MON (S. Mokhtar Ahmed) District –North 24 Parganas / MAR-20/03/2008/Sl.NO- 114 Victim(s) : Mantu Mondal Perpetrator(s) : BSF Officials Location : Kashipur Kuler Camp Date of incident : 14/02/2008 Case Details: Victim Mantu Mondal, aged 35, is a resident of Bangladesh. On 14 th February 2008 the victim came into India through the Indo-Bangladesh border near Kashipur Kuler Camp. He was a daily labourer and his family condition is very poor. The victim came to visit his sick maternal uncle Isahaq Mullick. The BSF Officials arrested him on the way to India, beat him with sticks and rifles, and detained him in the camp. Mantu’s left hand was fractured and the victim also sustained injuries all over his body. On 15 th February 2008 the officials handed Mantu over to Bagdah Police Station, who in turn produced him before Bongaon Court the next day. He was send to the hospital owing to his bad health. At the hospital the police cuffed his legs to the bed. On 26 th February 2008 Mantu was discharged and on 14 th March 2008 he was transferred to Dumdum Central Jail. Till 17 th march 2008 the family of the victim was not informed regarding the arrest. After inquiry it came to light that the victim had no legal documents to enter into India, and the FIR revealed the fact that he was actively involved in border crime and smuggling. Aptarul Hossain (a) Aktarul Jamal, aged 21 is a resident of Baronoberia village, falling under the jurisdiction of Gaighata Police Station. On 15 th February 2008 the victim was working in the field, during which he was shot by Birendra Kumar Singh, a BSF Constable. In order to cover their offence the BSF created a story that the victim was a native of Bangladesh, and he was shot when trying to escape with two other persons. Aktarul was then taken to Bongaon Sub Divisional Hospital. The FIR filed at Gaighata Police Station stated that a Bangladeshi currency of Rs.300 and an iron were seized from him. The BSF also prepared a memo of arrest but kept the place of arrest blank. The victim was forced to place his thumb impression on the same. In each seizure list prepared by the BSF the officials failed to get the signature of Aktarul which is mandatory. After investigation it came to light that the victim was an Indian citizen. He was shot by the constable below the left knee when Aktarul denied that he was Akbar. The whole incident was witnessed by two villagers. On 8 th July 2008 the victim was shifted to Dum Dum Correctional Home and produced before the Bongaon Court on 24 th June 2008. He had lost flexibility in his left leg and couldn’t stand. It was swollen and excreting some fluid. Aktarul was admitted in Bongaon Sub Divisional Hospital and then shifted to Gaighata Police Station. The police prepared a memo of arrest dated 8 th March 2008, having got the signature of the victim in it. The next day he was produced before the ACJM, Bongaon and was sent to judicial custody. The same day he was admitted in another hospital but not treated well. The case was transferred to the Additional District & Session Judge, Fast track, 2 nd Court, Bongaon but the victim was not produced before the court despite repeated reminders. After the intervention of a Ld. Advocate demanding bail and proper medical treatment for the victim, the court issued order to the Superintendent of Dum Dum Correctional Home to take effective steps for better treatment; but the bail was rejected. The next day of the case was fixed on 20 th August 2008 and the police has filed charge sheet against Aktarul. West Bengal 456 Annual Report on Torture 2007
