Mamoni Mondal, the daughter of Kanai protested against the illegal action of the police, and received a<br />

slap from Rajat Das, who was in a drunken state. Kanai was locked up and filed under two criminal<br />

cases in which he was not related, alleging him of offences in rioting with deadly weapons, attempt to<br />

murder and the like. The victim was purposefully implicated in these cases, but neither the FIR nor the<br />

complaints contained his name. On 27 th April 2008 the victim was produced before the ACJM, Lalbagh,<br />

and thereafter sent to Berhampore Central Correctional Home. It was alleged that Kanai was produced<br />

every month fortnightly before the court by tying him with a rope on a regular basis. On 26 th July 2008<br />

Kanai got bail in Raninagar Police Station, and he was released on 27 th July 2008.<br />

Case Details:<br />

The above mentioned victims are members of Nari Mukti Sangha (NMS), an association for the<br />

liberation of women. They gathered at Baghajatin Railway Station, on the occasion of the birthday of<br />

freedom fighter Sahid Bhagat Singh. They carried some posters containing slogans regarding International<br />

Women’s Day, Price hike and Nandigram issue. Some supporters of Hawkers’s Union affiliated with<br />

the CITU, raised objection. They compassed these ladies and locked them inside the party room of<br />

CPI(M). They also let inside the female members of Ganatantrik Mahila Samiti, a woman outfit of<br />

CPI(M). The police of Jadavpur Police Station arrived at the place, based on the information given by<br />

the CITU members and arrested the victims of NMS. The victims were taken to the police station<br />

without a lady police escort. Based on the suo-motto complaint lodged by the SI, the victims were<br />

produced before the court. Kanika and Bishnupriya were sent to judicial custody on 24 th March 2008.<br />

The other victims were sent to the jail by the ACJM of Alipore. The victims are still in jail. They were<br />

alleged of committing offences for criminal conspiracy and waging war against the State. The victims<br />

were also alleged of being active members of the MCC (Maoists). The posters were seized and the<br />

FIR was filed based on hearsay evidences, stating that they were raising anti-state and anti-government<br />

slogans. On 24 th March 2008 the police of Nimta and Jadavpur Police Stations searched the house of<br />

Kalpana, Secretary of NMS without any search warrant. The same day and on 31 st March 2008, the<br />

members of NMS organized a protest before Jadavpur Police Station and Alipore Court but the bail<br />

application of the arrested victims was rejected and they were sent to 14 days judicial custody.<br />
