FF Code : W.B. / MON (Susmita Roy Chowdhury) District –South 24parganas / Aug-19/08/2008/Sl.NO- 161 Victim(s) : Devjani Jha Perpetrator(s) : Jaydeep Das, Police Location : Naresh Mitra Sarani, Bhawanipore Date of incident : 20/06/2008, 18/07/2008, 30/07/2008 Case Details: Victim Devjani Jha, aged 51, is a resident of Naresh Mitra Sarani, falling under the jurisdiction of Bhawanipore Police Station. The victim is the proprietor of her business named ‘Global Link Consultants’, and her husband Rakesh Jha ran another firm named ‘Sapphire Marine’. A client in Rakesh’s business had lodged a complaint against him at Bhawanipore Police Station, over some dispute. Devjani was also tagged in the case in spite of the fact that the victim was in no way connected to her husband’s business. Rakesh got bail from the court on 13 th July 2008 and Devjani got bail the next day. The victim duly informed Bhawanipore Police Station about the bail granted. Following this, Devjani was regularly harassed by Joydeep Das, IO. He even advised the victim to stay away from her husband at her parents’ house. On 20 th June 2008 he barged into the house of Devjani at midnight and pushed down the servant maid. Thus the victim is facing occasional threats from the officer in the name of investigation. Devjani filed a petition supported by an affidavit before the CJM Court, Alipore seeking appropriate relief. Though she lodged complaints before several authorities everything was in vain. Victims Enayat, Soukat, Jahirul and Abdul were arrested by the officials of Rabindranath Police Station on 29 th August 2006. They were produced before the CJM, Alipore and sent to Alipore Correctional Home. The case was transferred to the 3 rd JM Court on 21 st November 2006 and they were produced before the magistrate. Victims Atiyar, Monjur, and Khokhon were arrested by Gosaba Police on 2 nd July 2007, and produced before the CJM, Alipore. They too were sent to Alipore Correctional Home. The case was transferred to the 1 st JM Court on 8 th September 2007 and they were produced before the magistrate. Victim Sheik Masud was arrested by Kasba Police on 27 th December 2006, and produced before the CJM, Alipore. He was also sent to Alipore Correctional Home. Ali, SI Location : Basanti, Ultadanga Date of incident : 22/03/2008 Case Details: Victim Fatema Khatun, aged 14 is the daughter of Sahanara Bibi. Her father passed away and the victim works as a servant maid. The family resides in Basanti, falling under the jurisdiction of Ultadanga Police Station. A small quarrel picked up between Fatema and her mother, owing to which she left the house. Sahanara tried searching her in all possible places, but in vain. Finally a complaint was lodged in Ultadanga Police Station after on 27 th February 2008. The police first refused to lodge the complaint but after much persuasion a missing diary was registered. The missing person squad of Lalbazar started searching for the girl. But Fatema returned home on 1 st September 2007, and Sahanara approached all the police officials including the Additional Officer-In-Charge of missing person squad of Lalbazar and informed them that her daughter had returned. Despite this, Sahanara and Fatema were often summoned to the police station and asked to narrate the happening. Fatema had been trafficked to Bihar, and subjected to sexual exploitation. On 22 nd March 2008 the victims were taken to the local club at Basanti Colony, Ultadanga, and two policemen who were in civilian attire compelled her to narrate the incident in the presence of the Secretary. Thus the victims are still being harassed by the police, and they are undergoing mental torture. FF Code : W.B./MON(S. Mukhtar Ahamed)/ District- North 24 Parganas/ July-14/07/08/ Sl.No.- 132 Victim(s) : Giasuddin Mondal Perpetrator(s) : 1) Ayub Ali, SI 2) Julfikaqr Ali Mollah, IIC Location : Deganga PS, North 24 Parganas Date of incident : 02/08/2007 Case Details: Victim Giasuddin Mondal is a resident of Basudevpur village, falling under the jurisdiction of Deganga Police Station. On 2 nd August 2007 the victim was arrested from his shop by the SI and five policemen of Deganga Police Station. At the station Giasuddin was subjected to brutal torture be the IIC. He was implicated in a number of cases dated 4 th August 2007. After being released from custody the victim was almost maimed and couldn’t resume his normal activities. Giasuddin lodged complaints before the SHRC, Chief Secretary, NHRC on 29 th August 2007 but no action was taken. Finally the IG and DIG initiated an inquiry into the alleged custodial torture upon the victim and called the concerned officials along with Giasuddin for an inquiry.
