Case Details:<br />

Dilip Ghosh was a lease holder who let many houses. All the tenants paid him the rent on regular basis.<br />

Before his death Dilip promised to transfer the land in the name of the tenants, but unfortunately he died<br />

without making any legal statement of the property. This paved way for a conflict between the family<br />

members of the deceased and the tenants. The latter filed a case in the court of Learned Executive<br />

Magistrate, Barackpore against the family members of Dilip Ghosh. On 22 nd July 2007 Jayanta Ghosh,<br />

the son of Dilip, two Counselors namely Shyamal and Puspendu along with 400 men came to demolish<br />

the houses of the tenants. Though messages were passed to the police they failed to assist the victims.<br />

The Chairman of the Municipality on the other hand claimed the land as their property, where the<br />

Municipality was going to establish a market. Arpita Saha got several injuries on her head. 9 families<br />

comprising of 40 members became houseless. Though police were informed of this they never arrived<br />

at the place to safeguard the victims. Subhas Mridha was one among the victim who belonged to the<br />

Scheduled Caste Community. Though the judgment fell in favour of the victims, nothing could stop the<br />

perpetrators from interfering into the life of the poor tenants, who were illiterate and knew not how to write<br />

even a complaint letter.<br />

Case Details:<br />

Victim Subhas Saha, aged 27, is a resident of Dayarampur village, falling under the jurisdiction of Jalangi<br />

Police Station. The victim lost his paddy field in the erosion caused by Padma River. Hence Subhas<br />

engaged is selling molasses of sugarcane, which he collected from the villagers. On 5 th Dec. 2007<br />

Subhas and his brother Subrata Saha went to the house of Sukumar Mondal to collect molasses. The<br />

victim loaded the tins and found them leaking. Subhas requested Sukumar to replace them, but the latter<br />

refused. The victim was forced to take the tins, and ultimately beat up Subhas. The victim fell down,<br />

following which he was kicked on his chest with shod legs. Subhas was also struck on his face that his<br />

teeth were dislocated oozing out blood. Subrata informed the incident to the nearby Debipur Police.<br />

Subhas was hospitalized, and later a written complaint was send to Jalangi Police Station. The ASI<br />

abused the victim with filthy words before filing the same. The things of Subhas were in the custody of<br />

Sukumar. The police took no step to recover those things. Though Subhas met the OIC of the station<br />

repeatedly regarding this, no action was taken.<br />
