Case Details:<br />

Victim Rabi Das, aged 55, was a resident of Harihar Pally village, falling under the jurisdiction of<br />

Metiabruj Police Station. The victim was arrested by few officials of Metiabruj Police Station neither<br />

issuing any memo of arrest, nor informing his family members about it, thereby violating the D.K. Basu<br />

judgment. At night the victim died in the police lock-up. The victim was taken to Garden Reach Hospital<br />

in a deceased condition, and the police officials created pressure upon the duty doctor to issue a death<br />

certificate, but the doctor sent the body for post mortem. The post mortem was conducted on 13 th<br />

February 2008 and the copy of the report was not given to family of the deceased. Rabi Das’ wife came<br />

to know of his death only from the mouth of local people.<br />

Victim Raju Roy, aged 35 was a resident of Charaktala, falling under the jurisdiction of Sankrail Police<br />

Station. He was married to Gouri Roy and they have a son aged 10 and a daughter aged 8 years. On<br />

11 th December 2007 the victim was arrested by two policemen from RPF (Railway Protection Force),<br />

who were clad in civilian attire. They neither produced the memo of arrest nor informed his family. He<br />

was alleged under the Unlawful Possession of Railway Property Act. On 12 th December 2007 Gouri<br />

came to know from Howrah Court that her husband was seriously ill. She went to the Correctional<br />

Home and found Raju being helped out by two prisoners. He was not able to stand and speak either. On<br />

14 th December 2007 Raju Roy died in the Medical College Hospital, and nobody informed Gouri about<br />

his death. A Radiogram message disclosed the news. From 15 th December 2007 to 19 th December<br />

2007 Gouri faced difficulties in getting back her husband’s body for cremation after the post mortem. The<br />

jail authorities and the police officials of Bowbazar Police Station asked her to bring the identity proof of<br />

her husband and the affidavit to deliver the body, for there was a confusion of names. She was<br />

repeatedly sent back to bring the original certificates. Thus the body was delivered to her only after the<br />

intervention of the human rights organization. There were suspicious injury marks all over the body of<br />

the deceased and it proves the fact that Raju had suffered torture in the hands of the Railway Police.<br />
