He took voluntary retirement from his service at Reckit Benckiser and got some money as his service benefit. The victim was introduced to Sanjay Sarkar of Kolkata by Anupam Roy Chowdhury. The former approached Kapil to invest money in his business and promised to return the same within 45 days. Accordingly Kapil handed Rs.3,00,000 to him on 23 rd August 2004. But the victim was deceived by Sanjay, who refused to pay even after repeated insistences. Kapil lodged complaints against the perpetrators at Behala Police Station on 4 th December 2005 and at Purba Jadavpur Police Station on 21 st March 2006. A written complaint was also send to the SP, but the police remained silent over the complaints. The perpetrators getting aware of the complaints lodged started torturing the victim’s family mentally and caused them to vacate Kolkata. Right now the family of Kapil is residing in Bihar, being pushed to a poor economic status. The police were trying to suppress the matter and washed their hands stating that the matter is very old. A new complaint needs to be filed in Behala and Purba Jadavpur Police Stations but the victim is not in a condition to come to Kolkata due to financial constraints. Moreover he states that the police failed to render security for the victim and his family. FF Code : W.B./MON (Julfikar Ali)/ District- Murshidabad/Apr-01/04/2008/Sl.No.- 186 Victim(s) : 1) Khodabox Mondal 2) Subra Bibi Perpetrator(s) : 1) Jayanta Bhattacharya, IIC 2) Mojibur Rahaman Location : Domkal PS, Murshidabad Date of incident : 03/12/2007 Case Details: Victim Khodabox Mondal, aged 48, is a resident of Maniknagar village, falling under the jurisdiction of Domkal Police Station. There was a dispute regarding a joint property among the relatives of the victim. On 5 th October 2007 Mojibur Rahaman and his associates attacked the family of the victim early in the morning. They carried away the ornaments and tried to molest the women. A case had been filed regarding this at Domkal Police Station dated 5 th October 2007. The FIR was signed by Md. Sallhauddin, SI. The perpetrators were arrested and soon after released under bail. Again these people attacked the victims’ house on 23 rd October 2007 during the absence of Khodabox. The next day a diary was lodged in Domkal Police Station but the police didn’t take any action. On 1 st December 2007 the accused attacked Nargis Bibi, the daughter of Khodabox with a log, and threatened her to vacate the house immediately. On 3 rd December 2007 the victim and his wife went to Domkal Police Station, but the IIC refused to accept their complaint, and threatened to detain them if they disturbed any further. Written complaints have been send to the SDO, SDPO, SP of Murshidabad regarding this. A petition has also been filed before the Sub-Divisional Magistrate court apprehending danger. He is a well known social activist in the locality. The victim also maintained good relations with the village people. On 22 nd January 2008 the victim was arrested by four officials of Canning Police Station during night. The police barged into his house, breaking open the entrance gate and assaulted him in the presence of his family members. Krishna was also abused with filthy words. He was taken to the police station in their jeep. In all these circumstances, the police violated the D.K. Basu Judgment. On 12 th January 2008 the victim was produced before Alipore Additional Chief Judicial Magistrate Court. It is reported that on 19 th January 2008, the officials of Canning Police Station wanted to arrest three persons illegally. When Krishna Debnath protested against it, the officials left the place. Holding grudge in their mind, the officials of Canning Police Station illegally arrested the victim under a fabricated case. Later the victim managed to come out on bail. Her husband Harananda Pathak was found missing for the past 19 years and the victim resides along with her son Biswajit Pathak. She gave all her daughters into marriage. Krishna manages the family by working in a factory at Park Circus Darga Road. From 2000 the victim entered into an affair with her colleague named Patitpaban Ghosh. Both got married but the marriage was not registered. After marriage they stayed at Krishna’s house along with her son. During this period the victim also left her job. Patitpaban left for his house at Janai during October 2007 and didn’t return. On 4 th December 2007 Krishna received news that he was going to marry another lady. On 4 th January 2008 Patitpaban called the victim to meet him, and Krishna requested him to come home. Accordingly he came and spend the night with her. On 5 th January 2008 few relatives of Patitpaban came to the house of the victim and abused her with filthy words. All of them tried to beat her but she was saved by her neighbours.
