Case Details:<br />

Victim Judhistir Adak is a carpenter residing in Gangadha village, falling under the jurisdiction of Chanditala<br />

Police Station. He was married to Mredula Adak and both have two daughters and a son. Judhistir is the<br />

only earning member of the family. There was a long standing property clash between the victim and his<br />

brothers Nani Gopal Adak and Parimal Adak. On several occasions the victim and his wife lodged<br />

dairies in Chaditala Police Station from 2003. Judhistir had ¼ shares in the joint property which was not<br />

fully partitioned, within which his brothers started constructing, and stopped the flow of water filling with<br />

mud. The victim filed a civil suit in the Court of the Civil Judge, Serampore. The Court passed an order<br />

of injunction on 1 st March 2007 which came into effect on 1 st June 2007. But on 1 st December 2007 in<br />

spite of the injunction order the youngest brother of Judhistir engaged masons in the property to construct.<br />

This happened when the victim was away from home, and his wife rushed to the police station for help<br />

but the officer on duty failed to receive the complaint. The victims also send a written complaint to the<br />

SDPO on 3 rd December 2007 but in vain.<br />

Case Details:<br />

Victim Kalipada Mondal, aged 75 is a resident of Bharatmata Colony, falling within the jurisdiction of<br />

Jaghacha Police Station. He worked in a jute mill and didn’t receive any retirement benefit. The victim<br />

stayed along with his sons and daughters-in-law. For the past few years Kalipada was pressurized by<br />

his children to divide the property. When the victim refused his sons grew furious and tortured him<br />

mentally. They often abused him with filthy words, beat him up mercilessly, and let him to starve.<br />

Kalipada lodged several diaries at Jaghacha Police Station from 2006 to 2007, but the police failed to<br />

initiate any action. On 29 th January 2008 Kalipada was beaten up badly and completely driven out of his<br />

house. The victim took shelter in his daughter’s house with no other way. He filed a petition before the<br />

Judicial Magistrate, and his sons were directed to give Rs.300 each per month to the victim, but<br />

Kalipada didn’t receive any.<br />
