Case Details:<br />

Victim Mohammed Shamim was a worker in Crown Cinema Hall. There was a dispute between his<br />

wife and himself regarding the marriage of Shamim’s sister. The groom’s family demanded a huge<br />

dowry and the victim assured to give them, which became a breach between the couple. His wife<br />

committed suicide setting herself on fire, the result of which a complaint was filed against Shamim by his<br />

in-laws. He was arrested by the police of Jadavpur Police Station along with his mother and two sisters.<br />

They were sentenced to life term imprisonment. Unfortunately Shamim passed away on 20 th March<br />

2008 during night in the jail. His mother and sister were informed that he died of heart attack, but the family<br />

doubted for he had died under judicial custody. The same day the body of the deceased was put in the<br />

morgue of Bangur Hospital, where it was kept in the open, leading to decomposition. Finally post<br />

mortem was conducted only on 26 th March 2008, i.e. after the media and the government took the case<br />

seriously. Jamila Khanam (a) Munni Bibi, one of the sisters of the deceased lodged a complaint before<br />

the SHRC. The last desire of Shamim’s mother and sisters to see the victim was also not fulfilled, owing<br />

to the procedures in the jail administration.<br />

Case Details:<br />

Victim Paran Molla is a mentally ill patient, residing in Bhagabanpur village. The victim has a maternal<br />

uncle named Jamat Gazi, who was a deity of Mazar. On 18 th March 2008 Paran Molla struck his uncle<br />

with a stone on his head, ultimately leading to his death. The people of the locality witnessed this and beat<br />

up Paran. Police arrived at the place and arrested the victim. But he died in police custody on 22 nd<br />

March 2008. The wife of the deceased denied giving any facts about the incident, and it seems that the<br />

family of the deceased victim is afraid of the police, and don’t want to take any action against them,<br />

despite the fact that Paran died under police custody. The police officials also denied giving any information<br />

regarding the incident.<br />
