The family of Haren Sardar also resides in the same village. A date tree was situated in the land of Kamal Sardar from where they collected the fluid by tying a pot. The children of Haren broke the pot, owing to which there was a quarrel between both the families on 2 nd February 2008. The victim’s wife and daughter were assaulted by Shyamal and Haren. Kamal lodged a complaint at Baruipur Police Station regarding this. The next day, Debasish Sardar, the elder son of Kamal was assaulted by Haren with a sword. The perpetrators also beat up Pratima and Anima, the daughters of Kamal. Gobinda Sardar, the younger son of Kamal was beaten with a bamboo stick at his back. Thus all the family members of Kamal were injured during the savage. The victimized family went to Baruipur Police Station on 3 rd February 2008, following which they were hospitalized. Debasish was declared dead. Though a case was registered dated 3 rd February 2008 against eleven persons, police didn’t inspect the place of the incident even after a lapse of five hours. The next day, Dilip Sardar, the brother of Kamal met the CI and the SDPO, following which they inspected the place. In the meantime, only two offenders namely Bhabes and Suranjan were arrested on 4 th February 2008 but the main offenders were moving about freely. When Dilip threatened the police to approach the media and thereby unveil the negligent act of the police he was driven away from the station, warning not to come back again. The perpetrators are close to the police and this is the reason for the indifferent attitude of the police, thus paving way for getting anticipatory bail from the court and filing just a weak charge sheet against them. FF Code : W.B./ MON (Murari Dey)/ District- Hooghly/ APR-16/04/2008/ SL NO-75 Victim(s) : Debu Malik Perpetrator(s) : 1) Priyabrata Baksi, OIC 2) IO Location : Singur, Hooghly Date of incident : 18/02/2008 Case Details: Victim Debu Malik, aged 48 is a resident of Singur village, falling under the jurisdiction of Singur Police Station. The victim had a friend named Shankar Choudhury who died on 18 th February 2008 under suspicious circumstances. Debu had gone to comfort the family, and at that time the Investigation Officer (IO) came to the house of the deceased and arrested the victim, against the complaint of Bholanath Chowdhury, brother of the deceased. The victim was locked up and detained him for two consecutive days, following which he was produced before the court on 22 nd February 2008. During the time Debu was detaine, he was not provided any food but was allowed to go home and eat. The police stated that the victim was arrested on grounds of suspicion and didn’t put his name in the FIR. West Bengal 408 FF Code : W.B. / MON (S. Mokhtar Ahmed) District –North 24 Parganas / AUG-16.08.2008/ Sl.NO- 137 Victim(s) : 1) Dhruba Biswas 2) Ujjal Biswas 3) Indrajit Biswas Perpetrator(s) : 1) BSF DG 2) IG 3) BSF DC 4) SP 5) Sub-Jailer Location : Angrail, Gaighata Date of incident : 07/05/2007 Case Details: Victims Dhruba Biswas, Ujjal Biswas and Indrajit Biswas are residents of Sabri village in Bangladesh. The three had come into the Indian boundary to visit their maternal uncle on 7 th May 2007 but were caught by the BSF Officials at Angrail. A case was started against the three at Gaighata Police Station dated 8 th May 2007, and the next day produced before the ACJM Court, Bongaon. From there they were sent to judicial custody. Since the victims acknowledged their mistake they were sentenced to rigorous imprisonment for 60 days and a fine of Rs.500. Despite the completion of the period of detention the victims were not released from Bongaon Sub Jail. A writ petition was filed before the High Court on behalf of the victims. The Hon’ble Justice directed all the concerned authorities to push back the victims into Bangladesh, in his order dated 3 rd April 2008. But the order was not followed. Again a petition was filed against the perpetrators under the Contempt of Courts Act. On 11 th September 2008 the authorities of Bongaon Sub Jail handed over the victims to the custody of the BSF for deporting them into Bangladesh. Annual Report on Torture 2007
