Case Details:<br />

Victim Ashes Khatua, aged 42, is a resident of Kalicharanpur village, falling within the jurisdiction of<br />

Nandigram Police Station. The victim is a supporter of Trinamul Congress, the party in opposition to the<br />

ruling party in <strong>West</strong> <strong>Bengal</strong>. Ashes ran a public telephone booth in the area to earn his livelihood. On 27 th<br />

March 2007 the above mentioned perpetrators, belonging to the CPI(M) blocked the way of the victim<br />

and beat him with wooden sticks and iron rods, thereby fracturing his left arm. Ashes went to Nandigram<br />

Police Station where the OIC just filed a general diary entry and chased him away from the station. The<br />

OIC was found talking with the perpetrators in his room, in a favourable mood. The police didn’t arrange<br />

for medical examination, and the victim got himself admitted in a local hospital. He was referred to<br />

SSKM Hospital where his left arm was operated. Ashes was discharged on 9 th April 2008. The police<br />

didn’t take any legal action against the accused persons and the perpetrators are often threatening the<br />

victim.<br />

Victim Asima Paria, aged 20, D/o Prabhas Paria is a resident of South Mokam Bera. A relative of the<br />

victim, Nani Paria by name had borrowed Rs.6500 from her father and failed to return it even after a<br />

lapse of many months. On 10 th February 2008 Nani Paria came to Asima’s house and threatened not<br />

to demand the money. He also attempted to outrage her modesty by undressing her. He fled from the<br />

place hearing the neighbours rush for help. Asima and her father went to lodge a complaint at Basanti<br />

Police Station the same day. On 12 th February 2008 the victim was examined by a doctor, following<br />

which she was threatened to withdraw the complaint. The same day the victim went to Basanti Police<br />

Station along with her father and got another complaint registered. After these things the police began to<br />

compel Asima to compromise the case and the OIC stated that the allegations are not serious in nature.<br />

They ultimately washed their hands by just filing a petty case against Nani and didn’t arrest him. On 18 th<br />

February 2008 the victim send a written complaint to the SP, and seeing that no help turned out from the<br />

police, a case was filed at Alipore Chief Judicial Magistrate court on 20 th February 2008.<br />
