Case Details:<br />
Victim Shyampada Mondal, aged 18, was working in Nepal at a shoe factory. He had come home to<br />
take more workers with him. On 24 th December 2007 the victim was returning home, and the cattle<br />
smuggling team was passing that way. All of a sudden the BSF Jawans fired at them by which the victim<br />
was injured. Shyampada’s mother reached the place and the victim narrated everything to her before<br />
dying. Subhas Gangua, Assistant Commander of BSF asked the victim’s family to compromise the<br />
case, and not take it the police. He also requested the OIC of Gaighata Police Station to settle the matter.<br />
The latter gave the family of the deceased Rs.10,000 so as to shut their mouths. The BSF Officials had<br />
lodged a complaint against Shyampada dated 24 th December 2007, but the Investigation Officer (IO)<br />
who handled the case suggested the victim’s family to lodge case against the BSF Officials, but the latter<br />
refused owing to their fear.<br />

Case Details:<br />
Victim Ramjan Seikh is a resident of Kalbalitala village, falling under the jurisdiction of Raninagar Police<br />
Station. The victim has no land and worked as a daily labourer. His youngest son Sirajul Seikh, aged 18<br />
decided to smuggle cattle across the border in order to sustain the family. He went out with his neighbour<br />
Aminul Seikh on 10 th February 2008 for this purpose. The victim was trying to smuggle cattle across the<br />
border near Kaharpara Out-Post. Sirajul was new to this profession. The BSF Officials traced them and<br />
began firing. All others who were with the victim managed to escape but Sirajul was shot into his chest<br />
through the right hand side ribs. He fell dead, and the following morning the body was sent to Raninagar<br />
Police Station along with a sharp weapon and a buffalo. Raninagar Police registered a case, alleging the<br />
deceased of attempt to murder, causing hurt with a dangerous weapon, and disobeying the orders of<br />
public servants. The body was sent to Lalbagh Sub-Divisional Hospital for post mortem. The father of the<br />
victim lodged a written complaint on 6 th March 2008 before the DM of Murshidabad against the BSF<br />
Officials for murdering his son, but no action followed.<br />
