The Government of India erected fences and a boundary road to prevent infiltration. In these areas many local people who have resided there for centuries cannot gain entry into their own land without the permission of the BSF. On 11 th July 2006 victims Mintu Molla and Jabbar Molla were returning home from their fields. Without warning the BSF Officials bounced over the victims and shot them dead. The next day morning, Bajlur Rahaman Mondal, elder brother of Jabbar and Mainul Molla, a relative of Mintu went to Jalangi Police Station to lodge a complaint against the BSF Officials. But the OIC refused to register the case and drove them away threatening not to arise against the BSF. Despite the complaints send to the SP of Murshidabad no action was taken. On 4 th September 2006 police from Jalangi Police Station came to the shop of Bajlur Rahaman and forced him to sign in a document. The case was taken to the Chief Judicial Magistrate Court, Berhampore on 31 st August 2007. Jabbar and Mintu were found innocent, but the case was not taken up for the victims had expired. Mukhtar Ahamed) District – North 24 Parganas / Aug– 18/08/2008/Sl.NO- 141 Victim(s) : 1) (Late) Rejaul Mondal 2) (Late) Jaynal Mondal Perpetrator(s) : 1) Monaj Kumar, BSF Constable 2) Babul Saha, BSF Commander 3) OIC Location : Mashampur Border Out-Post, Bagdah Date of incident : 18/07/2008 Case Details: Victims Rejaul Mondal and Jaynal Mondal, aged 30 and 23 respectively were residents of Supukar village, falling under the jurisdiction of Changachia Police Station. The victims were used by the BSF Officials to smuggle cattle across the border and in this process shot down on 19 th July 2008. Rejaul fell down inside the Indian territory and the other in Bangladesh territory. The bodies were handed over to Bagadh Police Station, who in turn registered an unnatural death case dated 19 th July 2008. The post mortem was conducted at J.R. Dhar Sub Divisional Hospital, Bongaon, following which the bodies were handed over to Bangladesh Rifles. The BSF Officials promptly lodged a complaint after the incident against the deceased victims at Bagdah Police Station, under punishment for criminal trespass and obstructing the public servant in discharge of public functions. The Bagdah Police filed the FIR on the basis of the complaint lodged by the BSF on 19 th July 2008 and the FIR was placed before the ACJM Court on 5 th August 2008, i.e. after several days from the date, which in itself is a violation. The victim was a student of Dr. B.R. Ambedkar Academy. His father owns some land at Mouza- Udayanarayanpur, located near the border. The surrounding lands are heavily affected by the illegal smuggling activities carried out by the local smugglers. On 17 th June 2008 Sentu went to smuggle cattle for the first time under the influence of some local persons. Suddenly they were chased by the BSF Officials of Singpara BSF Head Quarter. While others managed to escape, Sentu was caught and dragged to the camp. The officials beat him mercilessly. Ganeshan, the DIB attached to the Camp also beat Sentu with the butt of the rifle, and ruptured his genitals. There were injuries all over his body. The officials drowned his body into river Padma. At evening the body surfaced, following which it was sent for post mortem to Berhampore GH. The police of Jalangi Police Station filed an unnatural death case dated 19 th June 2008. The father of the deceased lodged a written complaint on 24 th June 2008 before the SP of Murshidabad, bringing allegations against the guilty BSF Officials but the police failed to initiate action against the perpetrators. Boro, BSF Constable Location : Madhupur Bridge, Bagdah Date of incident : 24/12/2007 Case Details: Victim Serajul Mondal, aged 14, S/o Rezaul Mondal was a resident of Hariharpur village, falling under the jurisdiction of Bagdah Police Station. The victim was living in Delhi, and had come home for Eid festival. On 24 th December 2007 Serajul went to meet his mother in Bangladesh, and while returning he was shot down by the BSF Jawans (Police). The father of the deceased states that his son didn’t die of firing, for there were deep injuries on his chest, as if assaulted with a sharp weapon. According to Sunil Yadav, Assistant Commander of BSF, five to six persons were coming from Bangladesh on the day of the incident. The officers fired at them for crossing the border without paying heed to the orders. The body was handed to Bagdah Police Station on 25 th December 2007, several hours after the death. The police registered a case of unnatural death. The BSF had lodged a complaint against Serajul, alleging him of criminal trespass, and assaulting the public servant. The family members of the deceased are afraid of lodging complaints against the BSF. They haven’t received the post mortem report till date despite various efforts.
