Case Details:<br />
India shares a considerable border with Bangladesh which is not so explicit. The Government of India<br />
erected fences and a boundary road to prevent infiltration. In these areas many local people who have<br />
resided there for centuries cannot gain entry into their own land without the permission of the BSF. On<br />
11 th July 2006 victims Mintu Molla and Jabbar Molla were returning home from their fields. Without<br />
warning the BSF Officials bounced over the victims and shot them dead. The next day morning, Bajlur<br />
Rahaman Mondal, elder brother of Jabbar and Mainul Molla, a relative of Mintu went to Jalangi Police<br />
Station to lodge a complaint against the BSF Officials. But the OIC refused to register the case and drove<br />
them away threatening not to arise against the BSF. Despite the complaints send to the SP of Murshidabad<br />
no action was taken. On 4 th September 2006 police from Jalangi Police Station came to the shop of<br />
Bajlur Rahaman and forced him to sign in a document. The case was taken to the Chief Judicial<br />
Magistrate Court, Berhampore on 31 st August 2007. Jabbar and Mintu were found innocent, but the<br />
case was not taken up for the victims had expired.<br />

Case Details:<br />
Victims Rejaul Mondal and Jaynal Mondal, aged 30 and 23 respectively were residents of Supukar<br />
village, falling under the jurisdiction of Changachia Police Station. The victims were used by the BSF<br />
Officials to smuggle cattle across the border and in this process shot down on 19 th July 2008. Rejaul fell<br />
down inside the Indian territory and the other in Bangladesh territory. The bodies were handed over to<br />
Bagadh Police Station, who in turn registered an unnatural death case dated 19 th July 2008. The post<br />
mortem was conducted at J.R. Dhar Sub Divisional Hospital, Bongaon, following which the bodies were<br />
handed over to Bangladesh Rifles. The BSF Officials promptly lodged a complaint after the incident<br />
against the deceased victims at Bagdah Police Station, under punishment for criminal trespass and<br />
obstructing the public servant in discharge of public functions. The Bagdah Police filed the FIR on the<br />
basis of the complaint lodged by the BSF on 19 th July 2008 and the FIR was placed before the ACJM<br />
Court on 5 th August 2008, i.e. after several days from the date, which in itself is a violation.<br />
