migration”. 209 In the op<strong>in</strong>ion of Bus<strong>in</strong>ess<strong>Europe</strong>, a key challenge to ensure the long-term benefits of<br />

circular migration is the need to design policies <strong>in</strong> such a way that circular migration rema<strong>in</strong>s circular<br />

and does not become permanent. In this sense, <strong>Europe</strong>an employers express doubts concern<strong>in</strong>g the<br />

effectiveness and/or feasibility of some of the actions proposed by the Commission – such as the<br />

requirement for a written commitment by migrants to return voluntarily, support to help the partner<br />

country create sufficiently attractive professional opportunities locally for the highly skilled etc. The<br />

Confederation makes note of the “potential contradiction between the strong emphasis put<br />

simultaneously on both circular and return migration on the one hand and the efforts to foster<br />

<strong>in</strong>tegration of third country nationals on the other hand”. 210<br />

Regard<strong>in</strong>g measures aga<strong>in</strong>st illegal migration, the Confederation supports the objective of the<br />

proposed sanctions for those employ<strong>in</strong>g illegal workers. Generally, Bus<strong>in</strong>ess<strong>Europe</strong> acknowledges<br />

that employment is one of many pull factors for illegal migration.. However, <strong>in</strong> the op<strong>in</strong>ion of<br />

Bus<strong>in</strong>ess<strong>Europe</strong>, the Commission proposal does not comply with the subsidiarity pr<strong>in</strong>ciple: “By<br />

<strong>in</strong>troduc<strong>in</strong>g EU-wide legal def<strong>in</strong>itions of ‘employment’ and ‘employer’, the proposal directly<br />

<strong>in</strong>terferes with national social and labour law. In addition, Member States are best placed to decide on<br />

and set effective sanctions for non-compliance with the provisions of the Directive.” 211 Accord<strong>in</strong>g to<br />

<strong>Europe</strong>an employers, the draft directive also fails to respect the proportionality pr<strong>in</strong>ciple: “It would<br />

impose overly burdensome and costly adm<strong>in</strong>istrative requirements on EU companies”. 212<br />

Furthermore, there should be a qualitative element to dist<strong>in</strong>guish between crim<strong>in</strong>al and adm<strong>in</strong>istrative<br />

sanctions. 213<br />

F<strong>in</strong>ally, <strong>in</strong> the view of Bus<strong>in</strong>ess<strong>Europe</strong>, action aga<strong>in</strong>st illegal migration must be accompanied by<br />

measures aimed at facilitat<strong>in</strong>g legal migration – sanctions aga<strong>in</strong>st those employ<strong>in</strong>g illegal workers<br />

should not be taken <strong>in</strong> an isolated way but accompanied by measures such as effective co-ord<strong>in</strong>ation<br />

with migrants’ countries of orig<strong>in</strong>, action to fight aga<strong>in</strong>st organised crime, and speedy repatriation of<br />

illegal migrants (consistent with their legitimate rights). 214 Furthermore, “to avoid a situation where an<br />

employer recruits workers with irregular status due to the lack of qualified or specific human<br />

resources and limited possibilities for legal migration, Bus<strong>in</strong>ess<strong>Europe</strong> reiterates the importance of<br />

creat<strong>in</strong>g unbureaucratic, rapid and transparent procedures at national level to recruit migrant<br />

workers”. 215<br />

For the purpose of this study, four po<strong>in</strong>ts are worth po<strong>in</strong>t<strong>in</strong>g out. First, Bus<strong>in</strong>ess<strong>Europe</strong> strongly<br />

emphasises the basic pr<strong>in</strong>ciple of subsidiarity. For the development of regularisation policies on the<br />

<strong>Europe</strong>an level this suggests that any policy that would reduce the flexibility of Member States to<br />

design national solutions to national problems is likely to be opposed. Conversely, sett<strong>in</strong>g quantitative<br />
