As the Commission communication on immigration, <strong>in</strong>tegration and employment of 2003 334 has<br />

reasoned, regularisation may <strong>in</strong>deed also be used to promote the <strong>in</strong>tegration of third country<br />

nationals <strong>in</strong> an irregular situation <strong>in</strong>to ma<strong>in</strong>stream society and, by implication, as a measure<br />

aga<strong>in</strong>st social exclusion and marg<strong>in</strong>alisation. Although regularisation and thus <strong>in</strong>tegration may not<br />

be the preferred option <strong>in</strong> deal<strong>in</strong>g with the presence of irregular migrants, irregular migrants should<br />

not be – a priori – excluded from the agenda of promot<strong>in</strong>g the <strong>in</strong>tegration of immigrants and fight<strong>in</strong>g<br />

social exclusion. This is not least s<strong>in</strong>ce the susta<strong>in</strong>ed presence of marg<strong>in</strong>alised groups without clear<br />

rights is clearly undesirable and may contribute to discrim<strong>in</strong>ation, racism and xenophobia. 335<br />

Moreover, several more fundamental legal pr<strong>in</strong>ciples and pr<strong>in</strong>ciples of good governance equally could<br />

be <strong>in</strong>voked <strong>in</strong> the development of regularisation policies, <strong>in</strong>clud<strong>in</strong>g legality (that is, that<br />

adm<strong>in</strong>istrative decisions should be taken after due process of the law, should follow clear and<br />

transparent procedures and should be based on clear criteria), the availability of legal remedies<br />

aga<strong>in</strong>st adm<strong>in</strong>istrative decisions, reasonable duration of adm<strong>in</strong>istrative procedures, nondiscrim<strong>in</strong>ation,<br />

and proportionality, amongst others.<br />

F<strong>in</strong>ally, <strong>in</strong> addition to follow<strong>in</strong>g certa<strong>in</strong> basic pr<strong>in</strong>ciples that have <strong>in</strong>formed the development of<br />

<strong>Europe</strong>an Union migration policy under the Tampere and Hague agendas (as well as more general<br />

legal pr<strong>in</strong>ciples), the development of regularisation policy on the <strong>Europe</strong>an level could also aim at<br />

some of the same general objectives of migration policy development <strong>in</strong> the <strong>Europe</strong>an Union. In<br />

particular, it could aim at harmonis<strong>in</strong>g procedures and procedural standards and harmonis<strong>in</strong>g the legal<br />

statuses of regularised migrants along with the attached rights and obligations.<br />
