Respected Sir,
Greetings from Yamuna Jiye Abhiyaan.
Sir, this appeal is in continuation of several made by us to your honour in the past
regarding the continuing willful occupation of river flood plain land measuring 61 acres
by the DTC in contravention of your directions as well as the DDA and DUAC Acts.
May we be allowed to draw your kind attention to the enclosed letter / RTI response
respectively received from the DDA and the IPGCL (Indraprastha Power Generation
Company Limited) that clearly indicates that the DDA is in process of taking action
against the DTC for violating the provisions of the Master Plan in respect of designated
land use for the land in question and that the IPGCL - who was in lawful possession of
the said land and had handed over the same to the DTC, temporarily as advised by your
good self only for the duration of the CWG 2010 - has sought return of its land from the
DTC. It is also a fact that the occupation of the said land by the DTC is sub-judice at the
High Court of Delhi in a PIL filed by Sri Vinod Jain of Tapas NGO.
Under the circumstances as mentioned above we find it very odd and indicative of the
'devil may care' attitude of a government agency like the DTC when it has gone ahead to
create a third party interest over the said land by partitioning the said area and allotting
part of it to private operator/s for parking of newly started orange colored buses under
the cluster plan of DTC. One has also seen earth work and construction activity going on
inside the said depot in violation of the directions of the DUAC which is a statutory
authority. It is also clear from the DDA's letter that the action of the DDA against the
DTC is in pursuance of the directions dated 3.12.2010 as made by the DUAC after a field
visit made to the site in question.
Accordingly may we request your honour to kindly get these facts verified and then
please prevent the DTC from creating third party interests over land that does not even
legally belong to it and for which it (DTC) is liable to face penal and demolition action
under section 29, 30 and 31 of the DDA Act. 1957.
