Respected Sir,<br />

Greetings from Yamuna Jiye Abhiyaan.<br />

Sir, this appeal is in continuation <strong>of</strong> several made by us <strong>to</strong> your honour in the past<br />

regarding the continuing willful occupation <strong>of</strong> river flood plain land measuring 61 acres<br />

by the <strong>DTC</strong> in contravention <strong>of</strong> your directions as well as the DDA and DUAC Acts.<br />

<strong>May</strong> we be allowed <strong>to</strong> draw your kind attention <strong>to</strong> the enclosed letter / RTI response<br />

respectively received from the DDA and the IPGCL (Indraprastha Power Generation<br />

Company Limited) that clearly indicates that the DDA is in process <strong>of</strong> taking action<br />

against the <strong>DTC</strong> for violating the provisions <strong>of</strong> the Master Plan in respect <strong>of</strong> designated<br />

land use for the land in question and that the IPGCL - who was in lawful possession <strong>of</strong><br />

the said land and had handed over the same <strong>to</strong> the <strong>DTC</strong>, temporarily as advised by your<br />

good self only for the duration <strong>of</strong> the CWG 2010 - has sought return <strong>of</strong> its land from the<br />

<strong>DTC</strong>. It is also a fact that the occupation <strong>of</strong> the said land by the <strong>DTC</strong> is sub-judice at the<br />

High Court <strong>of</strong> <strong>Delhi</strong> in a PIL filed by Sri Vinod Jain <strong>of</strong> Tapas NGO.<br />

Under the circumstances as mentioned above we find it very odd and indicative <strong>of</strong> the<br />

'devil may care' attitude <strong>of</strong> a government agency like the <strong>DTC</strong> when it has gone ahead <strong>to</strong><br />

create a third party interest over the said land by partitioning the said area and allotting<br />

part <strong>of</strong> it <strong>to</strong> private opera<strong>to</strong>r/s for parking <strong>of</strong> newly started orange colored buses under<br />

the cluster plan <strong>of</strong> <strong>DTC</strong>. One has also seen earth work and construction activity going on<br />

inside the said depot in violation <strong>of</strong> the directions <strong>of</strong> the DUAC which is a statu<strong>to</strong>ry<br />

authority. It is also clear from the DDA's letter that the action <strong>of</strong> the DDA against the<br />

<strong>DTC</strong> is in pursuance <strong>of</strong> the directions dated 3.12.2010 as made by the DUAC after a field<br />

visit made <strong>to</strong> the site in question.<br />

Accordingly may we request your honour <strong>to</strong> kindly get these facts verified and then<br />

please prevent the <strong>DTC</strong> from creating third party interests over land that does not even<br />

legally belong <strong>to</strong> it and for which it (<strong>DTC</strong>) is liable <strong>to</strong> face penal and demolition action<br />

under section 29, <strong>30</strong> and 31 <strong>of</strong> the DDA Act. 1957.<br />
