Government Information (Public Access) Act 2009<br />

The Government Information (Public Access) Act 2009 (NSW) (GIPA Act) replaced the Freedom <strong>of</strong> Information Act 1989 (NSW) on<br />

1 July 2010. The GIPA Act has established a comprehensive system for public access to government information. <strong>Endeavour</strong> <strong>Energy</strong><br />

is subject to the GIPA Act and is committed to complying with the GIPA Act in a fair and objective manner when dealing with<br />

external requests for access to company information and supports the proactive release <strong>of</strong> information where it is in the public<br />

interest to do so.<br />

Review <strong>of</strong> program for release <strong>of</strong> information<br />

In 2010–11 <strong>Endeavour</strong> <strong>Energy</strong> reviewed its program for release <strong>of</strong> information as required by the GIPA Act. This included updating<br />

policies and procedures regarding processing requests for access to government information; reviewing and publishing its<br />

publications guide; training staff in GIPA Act compliance; publication <strong>of</strong> contractual information into a centralised database;<br />

reviewing its website and publication <strong>of</strong> information regarding the network business such as the <strong>Annual</strong> Planning Statement and<br />

Network <strong>Performance</strong> <strong>Report</strong>.<br />

Total number <strong>of</strong> access applications received during the year<br />

In 2010–11 <strong>Endeavour</strong> <strong>Energy</strong> received 18 new formal requests for information pursuant to the GIPA Act. The formal requests were<br />

received from members <strong>of</strong> the public, members <strong>of</strong> <strong>Parliament</strong>, lawyers and investigators.<br />

In response to the 18 requests, full access was provided on 11 occasions and on one occasion the information was publicly available<br />

through the Internet. With respect to the remaining requests, 5 access applications were granted in part and one access application<br />

was refused in full. A variety <strong>of</strong> public interest considerations were taken into account in dealing with these applications and these<br />

are set out in Table E. In the course <strong>of</strong> determining access applications during the year <strong>Endeavour</strong> <strong>Energy</strong> did not rely on any <strong>of</strong> the<br />

conclusive presumptions <strong>of</strong> overriding public interest against disclosure (as set out in schedule 1 <strong>of</strong> the GIPA Act).<br />

provide a summary <strong>of</strong> the responses to requests pursuant to the GIPA Act in 2010–11.<br />
