8.2 Rotterdam Convention Article 3: Scope of the Convention: It applies to banned or severely restricted chemicals and severely hazardous pesticide formulations. Article 4: Designated National Authorities: Requires each Party to designate one or more national authorities that shall be authorized to act on its behalf in the performance of the administrative functions required by this Convention General Provisions: Each Party has obligation to:- • Facilitate the exchange of scientific, technical, economic and legal information concerning Annex III chemicals (Article 14); • Take such measures to establish and strengthen its national infrastructures and institutions for the effective implementation of this Convention (Article 15); • Cooperate in promoting technical assistance to enable implementation of this Convention taking into account the particular needs of developing countries and countries with economies in transition (Article 16); • The COP shall develop and approve procedures and institutional mechanisms for determining non-compliance with the provisions of this Convention (Article 17). 8.3 Stockholm Convention Article 1: Objective- To protect human health and the environment from the adverse effects of POPs. Article 5: Measures to reduce or eliminate releases from unintentional production • Develop Action Plan (regional or sub-regional) and implement it as part of the national implementation plan for POPs specified in Article 7, designed to identify, characterize and develop and maintain source inventories and release estimates, and promote measures including the use of best available techniques (BATs) and best environmental practices (BEPs). General provisions • Develop and implement NIP under the Convention within two years of its entry into force; • Facilitate and undertake information exchange on POPs including the establishment of a NFP; • Encourage and undertake research and monitoring of POPs and their alternatives; General Obligations • Designate a National Focal Point • Develop, implement and update an implementation plan 127
• Promote and facilitate a wide range of public information, awareness and education a measures for policy makers and all stakeholders • Encourage and, as resources permit, undertake research, development, monitoring and cooperation on all aspects of POPs and their alternatives • Report to the COP on: ‣ Measure taken by Party to implement the Convention ‣ Effectiveness of the measure taken ‣ data concerning trade in intentionally produced POPs Financial & Technical Assistance • Convention specifications: Developing countries and countries with economies in transition will need technical and financial assistance. • Regional and sub-regional centres will be established for capacity building an transfer of technology Developed countries will provide technical assistance and new and additional financial resources to meet agreed full incremental implementation costs. • Global Environment Facility (GEF) is named as the principle entity of the interim financial mechanism to handle funding of capacity building and other related activities 8.4 FAO Code of Conduct Objective: To establish voluntary standards and shared responsibilities to all stakeholders with respect to the distribution and use of pesticides (especially where there is inadequate or no legislation) so as to ensure effective and safe use of pesticides Articles 5.1/7.5/8/9.1/10.4: Governments to: • Implement registration & control scheme • Do health surveillances, and advise workers • Establish national poisoning control centres • Collect & maintain pesticides statistics • Provide extension advisory services • Monitor pesticides in foods • Prohibit Ia and Ib pesticides (if difficult to control) • License dealers, importers, exporters • Prohibit repackaging and decanting; especially in food and beverage containers • Encourage market driven supply centralized purchase (to minimize stocks) • Promote/facilitate networks for information exchange Looking at the provisions above one may see that there synergism, especially in the area of capacity building, information sharing, research, awareness raising, 128
