<strong>in</strong>formal contacts and be<strong>in</strong>g able to correctly<br />

identify the <strong>in</strong>fluential figures <strong>in</strong> the various<br />

government bodies. Popular action, for example<br />

demonstrations to protest land disputes and<br />

labor disputes, lends weight and legitimacy to<br />

advocacy efforts. F<strong>in</strong>ally, good coord<strong>in</strong>ation and<br />

understand<strong>in</strong>g between NGOs and IOs are also<br />

cited as factors that contribute to successful<br />

campaigns.<br />

Obstacles to Success<br />

The pervasive reluctance by government<br />

officials to open up the legislative process to<br />

<strong>in</strong>clude civil society organizations represents<br />

the most difficult obstacle encountered by<br />

advocates. Lack of legal technical skills is also a<br />

h<strong>in</strong>drance. Translation of drafts has also been<br />

cited as an obstacle <strong>in</strong> achiev<strong>in</strong>g agreement<br />

between stakeholders on a number of legislative<br />

bills, as was the case with the Land Law.<br />

Important issues to consider<br />

when try<strong>in</strong>g to <strong>in</strong>fluence the<br />

legislative process:<br />

• Issues should be identified<br />

us<strong>in</strong>g different methods such as<br />

surveys and case studies, and<br />

research should identify articles<br />

be<strong>in</strong>g violated <strong>in</strong> order to build<br />

an argument for change.<br />

Conclusion<br />

Yeng Virak concludes that <strong>in</strong> most cases<br />

legislative lobby<strong>in</strong>g has not resulted <strong>in</strong><br />

satisfactory outcomes, i.e., <strong>in</strong> sound laws that<br />

mitigate negative impact. However, some<br />

change objectives have been reached.<br />

Achievements made by civil society<br />

organizations <strong>in</strong> their advocacy efforts have<br />

centered primarily on education of stakeholders<br />

about the process and enlarg<strong>in</strong>g the democratic<br />

space. Advocates are ga<strong>in</strong><strong>in</strong>g experience and<br />

build<strong>in</strong>g their advocacy skills while<br />

implement<strong>in</strong>g advocacy campaigns on various<br />

laws.<br />

Dur<strong>in</strong>g the course of this research it<br />

became apparent that NGOs need to develop<br />

their capacity to <strong>in</strong>fluence lawmakers dur<strong>in</strong>g the<br />

legislative process and apply pressure on the<br />

government to make the process of pass<strong>in</strong>g<br />

legislation and regulations transparent and<br />

participatory. The need for consultative<br />

procedures looms large and the country would<br />

benefit from <strong>in</strong>stitutionaliz<strong>in</strong>g processes that<br />

enable and ensure public participation <strong>in</strong><br />

politics. Along these l<strong>in</strong>es, Yeng Virak suggests<br />

<strong>in</strong>stitutionalization of a two-hear<strong>in</strong>g process for<br />

every piece of legislation <strong>in</strong>troduced. This would<br />

require that hear<strong>in</strong>gs take place both at the<br />

executive level and at the legislative level, <strong>in</strong><br />

which the public could participate and provide<br />

<strong>in</strong>put.<br />

• There is a need to build<br />

coalitions and avoid overlapp<strong>in</strong>g<br />

of advocacy efforts.<br />

• Advocates need to understand<br />

the legislative process clearly.<br />

• At the legislative level,<br />

advocates need to stay one step<br />

ahead of the draft law.<br />

• Advocates need to cont<strong>in</strong>ue<br />

their efforts after laws are<br />

passed, as the executive branch<br />

may issue sub-decrees soon after<br />

enactment which should also be<br />

monitored. Monitor<strong>in</strong>g of<br />

enforcement should also be<br />

<strong>in</strong>cluded as part of the advocacy<br />

effort.<br />
