If you order imprisonment for default <strong>of</strong> payment, the prison sentence must follow the scale<br />

below: reg 26(1) <strong>Island</strong> <strong><strong>Court</strong>s</strong> Regulations (Cap 3).<br />

You must not impose imprisonment unless it is proved that the person not paying the debt had<br />

the funds to do so, but refused or neglected to pay it: reg 26(1) <strong>Island</strong> <strong><strong>Court</strong>s</strong> Regulations (Cap<br />

3).<br />

Also, the Enforcement <strong>of</strong> Judgments (Payment from Wages) Act (Cap 94) gives you additional<br />

power to order direct deduction from a person’s salary when they are working. This will be<br />

helpful in many cases and prevent imprisonment.<br />

Note that going to prison for failing to pay the debt does not extinguish the debt to be paid: reg<br />

26(1) <strong>Island</strong> <strong><strong>Court</strong>s</strong> Regulations (Cap 3).<br />

5.5 Delivering Your Judgment<br />

• consider all the evidence given and either accept it or reject it; and<br />

• give reasons.<br />
