Supplying a minor<br />

Section s99(1) and (2) Alcoholic Drinks Act 1984 (Cap 69)<br />

Description<br />

(1) Every licensee is guilty <strong>of</strong> an <strong>of</strong>fence who sells or supplies<br />

alcohol to a person under 18 years, or permits it.<br />

(2) Every employee <strong>of</strong> a licensee is guilty <strong>of</strong> an <strong>of</strong>fence who<br />

knowingly sells or supplies any alcohol to a person under 18 years.<br />

Elements • The person named in the charge is the same person who is<br />

appearing in <strong>Court</strong>;<br />

Specific under s99(1):<br />

• The accused is the holder <strong>of</strong> a publican’s license;<br />

• The accused sold or supplied, alcohol to a person, or<br />

permitted it;<br />

• the accused knew that the person supplied was under 18<br />

years.<br />

Specific under s99(2):<br />

• The person named in the charge is the same person who is<br />

appearing in <strong>Court</strong>;<br />

• The accused is an agent or servant <strong>of</strong> a licensee;<br />

• The accused sold or supplied alcohol to a person;<br />

• The person supplied was under 18 years;<br />

• The accused knew that the person was under 18 years.<br />

Commentary<br />

Burden and standard <strong>of</strong> pro<strong>of</strong><br />

The prosecution must prove all the elements beyond reasonable<br />

doubt. If the defence establishes to your satisfaction that there is a<br />

reasonable doubt, then the prosecution has failed.<br />

Identification<br />

In <strong>Court</strong>, the prosecution should identify the person charged by<br />

clearly pointing out that person in <strong>Court</strong>, and provide evidence to<br />

prove that it was the accused who sold or supplied the alcohol or<br />

permitted it.<br />
