In the event <strong>of</strong> a person whom such a notice is served fails to comply with the requirements <strong>of</strong><br />

the notice, you may issue a warrant <strong>of</strong> arrest: s80(2) CPC.<br />

The summons should:<br />

• be signed by the Police <strong>of</strong>ficer preferring the charge;<br />

• be directed to the person summoned; and<br />

• be placed before the <strong>Court</strong> at least 7 days before the time for hearing.<br />

This section applies to all <strong>of</strong>fences punishable by:<br />

• fine;<br />

• imprisonment, with or without a fine, for a term not exceeding 3 months; and<br />

• disqualification from holding or obtaining a drivers’ license.<br />

2 The Charge<br />

2.1 General Requirements<br />

A formal charge is an accusation <strong>of</strong> the commission <strong>of</strong> an <strong>of</strong>fence.<br />

The following persons may be joined in one charge and maybe tried together:<br />

• persons accused <strong>of</strong> the same <strong>of</strong>fence committed in the course <strong>of</strong> the same transaction;<br />

• persons accused <strong>of</strong> an <strong>of</strong>fence and persons accused <strong>of</strong> abatement, or <strong>of</strong> an attempt to<br />

commit such <strong>of</strong>fence;<br />

• persons accused <strong>of</strong> different <strong>of</strong>fences provided that all <strong>of</strong>fences are founded on the same<br />

facts, or form or are part <strong>of</strong> a series <strong>of</strong> <strong>of</strong>fences <strong>of</strong> the same or similar character; and<br />

• persons accused <strong>of</strong> different <strong>of</strong>fences committed in the course <strong>of</strong> the same transaction:<br />

s121 CPC.<br />

A charge should be filed:<br />

• at the <strong>Court</strong> within the district in which the <strong>of</strong>fence is alleged to have been committed<br />

(wholly or partly);<br />

• at the <strong>Court</strong> within the district in which the defendant was apprehended; or<br />

• at the <strong>Court</strong> within the district in which the defendant is in custody or has appeared in<br />

answer to a summons: ss56 - 64 CPC.<br />
