Q&A Q A& Q A Greg Ujiye, B.Sc.Phm. Manager, Pharmacy Practice Programs PRACTICE QHas the Drug and Pharmacies Regulation Act been changed to allow prescriptions from out of the province? This question refers to s. 158 of the DPRA which states: A pharmacist may dispense a drug pursuant to a written order signed by a physician or dentist licensed to practise in a province in Canada other than Ontario, if in the professional judgment of the pharmacist the patient requires the drug immediately, but such order shall not be refilled. In the strict legal sense, only prescriptions that the pharmacist believes that a patient immediately needs (in their professional judgement) can be filled. However, prescriptions written in other provinces have been an issue for Ontario pharmacists for some time — especially since Ontario patients often receive health services from a bordering province (Manitoba or Quebec). In these border community situations, pharmacists are expected to use their professional judgment to verify the authenticity of a prescription order and to ensure optimal patient care. Pharmacists are also expected to make their decisions in the best interests of the patient. The issue of cross-border fills was first considered by Council in June 1999. At that time, Council “approved in principle”, that amendments be made to the DPRA to accept transfers from pharmacists from any province in Canada and to fill prescriptions written by prescribers across Canada. All other provinces permit this practice. These amendments have not been approved nor adopted by the Ontario Government. The situation is further confused as the proposed amendments to the DPRA allowing pharmacists to fill prescriptions from other Canadian prescribers was, along with the new Proprietary Misconduct Regulations, published in the July-August 2002 issue of Pharmacy Connection for member and stakeholder feedback and eventual re-submission to the government. Please bear in mind that these regulations remain as proposals that still require government approval and adoption. QI wish to subdivide my pharmacy to permit me to operate a “lock and leave” pharmacy. What must I do? Do I need to inform the College? In 1997, Council approved a recommendation from the Accreditation Committee to amend the DPRA regulations that require members to notify the College whenever they intend to operate a subdivided or “lock and leave” pharmacy. As such, the pharmacy must be constructed to separate the dispensary and non-prescription drug products (Schedules II and III) from general merchandise (unscheduled products). College inspectors have found instances where changes have been made to pharmacies without the College being notified. Simply ticking the “lock and leave” check box on your annual Certificate of Accreditation renewal does not constitute proper notification to the College that you intend to operate a “lock and leave”. Notifying the College When you notify the College of your intent to implement a “lock and leave” operation, the College will: • Send you the requirements for operating a “lock and leave” pharmacy • Require your pharmacy’s designated manager or owner to sign and submit an updated floor plan 16 Pharmacy Connection July • August 2003
Q&A • Ensure that all relevant documentation is included in the pharmacy’s file so it can be later reviewed by a College inspector “Lock and Leave” Design The pharmacy must be constructed to ensure that the area can be locked and made inaccessible to the public when a pharmacist is not on the premises. • The barrier must be at least 2.44 metres (8 feet) hight and wide enough to render the area inaccessible (amended March 2001) • If the barrier does not extend to the floor, it cannot be more than 15 centimeters from the floor • All products must be at least one meter from the barrier if it is possible for a person to reach products either over the top, under the bottom, or through the barrier The barrier should be constructed so that front store staff can also access the back storage areas and staff facilities whenever the barrier is in place. Situations where such access can only be achieved by opening the barrier are in violation of the policy. In such situations the pharmacy is considered opened and unsupervised. No drugs in the Food and Drug Act, Controlled Drugs and Substances Act or National Schedules I, II, or III may be sold while the pharmacy is closed. As well, the pharmacy phone must not be answered during the absence of an on-duty pharmacist. Renovations Creating a “lock and leave” is considered a renovation. Any renovation where the physical structure of the pharmacy is changed must be reported to the College. These changes include moving or changing the size of the dispensary, moving or removing walls, or expanding or decreasing the size of the pharmacy. In these cases, the designated manager or owner must sign and submit an updated copy of the floor plan.
