Panel felt that the Discipline Committee<br />

must address the misconduct <strong>of</strong><br />

the Member without getting tied into<br />

pharmacy scheduling demands. The<br />

parties addressed the Panel’s concern,<br />

and came up with alternative dates for<br />

the Member to serve his suspension in<br />

a consistent block <strong>of</strong> time.<br />

Having addressed these areas <strong>of</strong> concern,<br />

the Panel was satisfied with the<br />

remainder <strong>of</strong> the Joint Submission.<br />

Order:<br />

1. A reprimand.<br />

2. Specified terms, conditions and limitations<br />

on the Member’s Certificate<br />

<strong>of</strong> Registration, and, in particular,<br />

that the Member:<br />

a) confirm in writing to the Manager,<br />

Investigations and Resolutions, the<br />

name and address <strong>of</strong> each pharmacy<br />

in which he practises as a<br />

dispensing pharmacist;<br />

b) provide a copy <strong>of</strong> the decision <strong>of</strong><br />

the Discipline Committee from<br />

the Discipline hearing <strong>of</strong> October<br />

8, 2008 (“Decision”) to the<br />

Designated Manager <strong>of</strong> any place<br />

in which he practises, within one<br />

week from the date <strong>of</strong> receipt <strong>of</strong><br />

the Decision;<br />

c) request that any Designated Manager<br />

to whom a copy <strong>of</strong> the Decision<br />

has been provided write to<br />

the Manager, Investigations and<br />

Resolutions, to confirm receipt <strong>of</strong><br />

the Decision; and<br />

d) until June 14, <strong>2009</strong>, refrain from<br />

providing counselling to anyone<br />

under the age <strong>of</strong> 18 years <strong>of</strong> age<br />

unless in the presence <strong>of</strong> another<br />

person 18 years <strong>of</strong> age or older.<br />

3. A suspension <strong>of</strong> the Member’s Certificate<br />

<strong>of</strong> Registration for a period<br />

<strong>of</strong> two months.<br />

4. Costs to the <strong>College</strong> in the amount<br />

<strong>of</strong> $4,500.00.<br />

Reprimand<br />

The Panel had a difficult time reviewing<br />

this case, due to the nature <strong>of</strong> the<br />

misconduct.<br />

The Member is now aware that the<br />

actions he takes in his personal life can<br />

and do have a significant impact, not<br />

only on him but also on the pr<strong>of</strong>ession,<br />

since such actions shake the trust the<br />

public has in their pharmacist. The<br />

Panel appreciated how embarrassing<br />

the experience <strong>of</strong> going through the<br />

criminal process must have been for the<br />

Member, but it wanted the Member to<br />

consider how uncomfortable it must<br />

have been for the Member’s patients to<br />

have learned that someone they trusted<br />

and relied upon, when their children<br />

or they themselves were sick, had engaged<br />

in viewing child pornography.<br />

The Panel hoped that the Member<br />

learned a valuable lesson throughout<br />

this process, and did not expect to see<br />

him before the Discipline Committee<br />

again.<br />
