After approving a plat, a county subject to Subchapter B shall issue to the person<br />

applying for the approval a certificate of approval of the plat. The commissioners<br />

court on its own motion or certain people may request that the county make<br />

determinations regarding a lot=s or subdivision’s water, sewer, electrical and gas<br />

facilities. A county may adopt rules necessary to administer the duties of this<br />

section. It may also impose a fee for a certificate issued for a subdivision, which is<br />

located in the county and not within the limits of a municipality. The fee may be the<br />

greater of $30 or the amount of the fee imposed by the municipality for a subdivision<br />

located entirely in the extraterritorial jurisdiction of the municipality for a certificate<br />

issued under Section 212.0115 of the Local Government Code.<br />

In counties of which any part is located within 50 miles of an international border, a<br />

utility may not serve or connect any subdivided land with electricity or gas unless the<br />

entity receives a certificate from the commissioners court that adequate water and<br />

sewer services have been installed to service the lot or subdivision.<br />

A utility that does not hold a certificate or has not received a determination about a<br />

certificate, can still provide electricity or gas to a single-family residential dwelling if<br />

certain conditions are met.<br />

The commissioners court may impose a fee for a certificate issued under this section<br />

for a subdivision which is located in the county and not within the limits of a<br />

municipality. The fee may be the greater of $30 or the amount of the fee imposed by<br />

the municipality for a subdivision that is located entirely in the extraterritorial<br />

jurisdiction of the municipality for a certificate issued under Section 212.0115 of the<br />

Local Government Code.<br />

In counties where any part of which is within 100 miles of an international border<br />

that contains the majority of the area of a municipality with a population of more<br />

than 250,000, the commissioners court must certify that subdivided land has been<br />

platted before utilities can be installed.<br />

The commissioners court shall adopt and enforce the model rules developed under<br />

Sec. 16.343 of the Water Code and other regulations.<br />

A commissioners court may impose a fee on a subdivider of property under this<br />

subchapter for an inspection of the property to ensure compliance with the<br />

subdivision regulations.<br />
