This regulation is not contrary <strong>to</strong> HIPAA because:<br />

1) Covered entities are required by law <strong>to</strong> disclose <strong>to</strong><br />

<strong>the</strong> Council;<br />

2) Council may use or disclose information in<br />

accordance with state law because it is not a<br />

covered entity under HIPAA;<br />

3) Even if <strong>the</strong> department or <strong>the</strong> council were<br />

covered entities, <strong>the</strong> disclosures would be authorize<br />

because HIPAA permits disclosure <strong>of</strong> PHI for certain<br />

public health purposes. 45 C.F.R. ' 164.512(b).<br />
