Today, <strong>the</strong> Housing Court, as this Part is known, is<br />

comprised <strong>of</strong> approximately fifty such hearing <strong>of</strong>ficers (now<br />

called Housing Judges), who preside over all residential landlord<br />

and tenant cases in <strong>New</strong> <strong>York</strong> City. These judges are appointed<br />

by <strong>the</strong> Chief Administrative Judge <strong>of</strong> <strong>the</strong> <strong>State</strong> <strong>of</strong> <strong>New</strong> <strong>York</strong> from<br />

an annual list compiled by <strong>the</strong> Advisory Council, a fourteen<br />

member panel comprised <strong>of</strong> representatives from <strong>the</strong> real estate<br />

industry, tenants’ organizati<strong>on</strong>s, civic and bar groups, a mayoral<br />

appointee and members <strong>of</strong> <strong>the</strong> public.<br />

Recognizing <strong>the</strong> importance <strong>of</strong> <strong>the</strong> Housing Court and<br />

<strong>the</strong> fact that its hearing <strong>of</strong>ficers already functi<strong>on</strong> as<br />

c<strong>on</strong>stituti<strong>on</strong>al judges in every sense <strong>of</strong> <strong>the</strong> word, our plan calls<br />

for <strong>the</strong> Housing Court and its judges to be accorded<br />

c<strong>on</strong>stituti<strong>on</strong>al status. The Housing Court would remain a<br />

distinct branch within <strong>the</strong> larger District Court, so that its<br />

present functi<strong>on</strong> as an accessible, user-friendly court for<br />

residential landlord and tenant issues is preserved.<br />

We do, however, call for a change to <strong>the</strong> way Housing<br />

Court judges are selected. While, in our view, <strong>the</strong> Chief<br />

Administrative Judge and <strong>the</strong> Advisory Council have d<strong>on</strong>e an<br />

exemplary job <strong>of</strong> working in tandem to select <strong>the</strong> most qualified<br />

and appropriate judges for <strong>the</strong> Housing Court to date, we believe<br />

that under a restructured system, <strong>the</strong> role <strong>of</strong> OCA is better suited<br />

to <strong>the</strong> administrati<strong>on</strong> <strong>of</strong> <strong>the</strong> courts and that <strong>the</strong> process <strong>of</strong> selecting<br />

judges should be left to o<strong>the</strong>rs. Our proposal <strong>the</strong>refore calls for <strong>the</strong><br />

retenti<strong>on</strong> <strong>of</strong> <strong>the</strong> Advisory Council but for <strong>the</strong> Mayor <strong>of</strong> <strong>New</strong> <strong>York</strong><br />

City to select <strong>New</strong> <strong>York</strong> City’s Housing Court judges.<br />

We have c<strong>on</strong>sidered whe<strong>the</strong>r to recommend <strong>the</strong> electi<strong>on</strong><br />

<strong>of</strong> Housing Court judges and believe this to be inadvisable.<br />

Unlike o<strong>the</strong>r aspects <strong>of</strong> <strong>the</strong> judicial selecti<strong>on</strong> issue, <strong>the</strong>re is a<br />

c<strong>on</strong>sensus that providing for <strong>the</strong> electi<strong>on</strong> <strong>of</strong> Housing Court judges<br />

would be a mistake given <strong>the</strong> potential influence that could be<br />

brought to bear in <strong>the</strong> funding <strong>of</strong> such electi<strong>on</strong>s. While o<strong>the</strong>rs<br />

examining <strong>the</strong> broader questi<strong>on</strong> <strong>of</strong> judicial selecti<strong>on</strong> may arrive<br />

at a different view, we believe that <strong>the</strong> Advisory Council should<br />

c<strong>on</strong>tinue to screen and recommend candidates for <strong>the</strong> Housing<br />

Court, and that <strong>the</strong> Mayor <strong>of</strong> <strong>New</strong> <strong>York</strong> City should select judges<br />

from this pool.<br />
