safety and facilitate access to specialized services. 130 The IDV<br />

c<strong>on</strong>cept was first implemented in 2001 and took <strong>the</strong> efforts <strong>of</strong> <strong>the</strong><br />

Domestic Violence <strong>Courts</strong> a step fur<strong>the</strong>r – assigning <strong>on</strong>e judge to<br />

handle a domestic violence victim’s related civil and criminal<br />

cases. 131 In approximately twenty percent <strong>of</strong> criminal domestic<br />

violence cases, <strong>the</strong>re is a related matter in ano<strong>the</strong>r court.<br />

<strong>the</strong> Br<strong>on</strong>x IDV court where <strong>the</strong><br />

lawyers presented us with two<br />

c<strong>on</strong>flicting orders; an order<br />

from <strong>the</strong> Criminal Court mandating<br />

that <strong>the</strong> mo<strong>the</strong>r stay out<br />

<strong>of</strong> <strong>the</strong> home and a Family<br />

Court order <strong>of</strong> protecti<strong>on</strong><br />

against <strong>the</strong> fa<strong>the</strong>r. The children<br />

were standing <strong>the</strong>re with<br />

no <strong>on</strong>e to take care <strong>of</strong> <strong>the</strong>m. As<br />

an integrated Supreme Court<br />

we were able to modify <strong>the</strong> orders<br />

so that <strong>on</strong>e parent could<br />

care for <strong>the</strong> children in <strong>the</strong><br />

home.”<br />

Under <strong>the</strong> IDV “<strong>on</strong>e family/<strong>on</strong>e-judge” model, both<br />

criminal and civil matters, such as custody, visitati<strong>on</strong>, civil<br />

protecti<strong>on</strong> orders and matrim<strong>on</strong>ial acti<strong>on</strong>s, are handled by <strong>on</strong>e<br />

judge, ra<strong>the</strong>r than various judges in different courts. In this way,<br />

<strong>the</strong> IDV <strong>Courts</strong> simplify <strong>the</strong> process for litigants and allow <strong>the</strong>m<br />

to overcome <strong>the</strong> artificial jurisdicti<strong>on</strong>al barriers <strong>of</strong> <strong>New</strong> <strong>York</strong>’s<br />

complex trial court structure. Moreover, this approach promotes<br />

better and more c<strong>on</strong>sistent judicial decisi<strong>on</strong>-making and requires<br />

fewer court appearances by <strong>the</strong> victim. Like Domestic Violence<br />

<strong>Courts</strong>, IDV <strong>Courts</strong> ensure intensive <strong>of</strong>fender m<strong>on</strong>itoring and<br />

accountability and enhanced access to services for victims and<br />

<strong>the</strong>ir families. 132<br />

The basis for IDV Court jurisdicti<strong>on</strong> is <strong>the</strong><br />

interrelati<strong>on</strong>ship between <strong>the</strong> family, criminal and matrim<strong>on</strong>ial<br />

matters that can face a single family. The threshold requirement<br />

for entry into IDV Court is a criminal case involving domestic<br />

violence and a case in Family Court or a matrim<strong>on</strong>ial case in<br />

Supreme Court (or both) where <strong>the</strong> cases have a party in<br />

comm<strong>on</strong>. IDV <strong>Courts</strong> may also take Family Court cases toge<strong>the</strong>r<br />

with Supreme Court cases, even if <strong>the</strong>re is no criminal case<br />

pending, where <strong>the</strong> cases have at least <strong>on</strong>e party in comm<strong>on</strong>,<br />

provided <strong>the</strong>re are allegati<strong>on</strong>s <strong>of</strong> domestic violence in at least <strong>on</strong>e<br />

case. 133 Once eligible cases are identified, <strong>the</strong>re are protocols in<br />

place to transfer <strong>the</strong>m at <strong>the</strong> earliest stage from <strong>the</strong> originating<br />

courts to <strong>the</strong> IDV Court.<br />
