recommendati<strong>on</strong> was <strong>the</strong> creati<strong>on</strong> <strong>of</strong> a Fifth Judicial Department<br />

that would c<strong>on</strong>sist <strong>of</strong> <strong>the</strong> Ninth and Tenth Judicial Districts. 91<br />

However, nei<strong>the</strong>r <strong>of</strong> <strong>the</strong>se recommendati<strong>on</strong>s was ever c<strong>on</strong>sidered<br />

by <strong>the</strong> Legislature. 92<br />

The Vance <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> (1974 – 1976)<br />

Shortly after he was elected governor in 1974, Hugh<br />

Carey appointed a Task Force <strong>on</strong> Judicial Selecti<strong>on</strong> and Court<br />

Reform, chaired by Cyrus Vance. 93 In a memorandum and<br />

proposed c<strong>on</strong>stituti<strong>on</strong>al amendment, <strong>the</strong> “Vance <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>,”<br />

as it was known, called for changes in (1) <strong>the</strong> method <strong>of</strong> selecting<br />

judges, (2) <strong>the</strong> number <strong>of</strong> trial courts in <strong>the</strong> state, (3) judicial<br />

discipline, (4) court administrati<strong>on</strong>, and (5) court financing. 94<br />

With respect to <strong>the</strong> <strong>New</strong> <strong>York</strong> <strong>State</strong> trial courts, <strong>the</strong> Vance<br />

<str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> called for <strong>the</strong> merger <strong>of</strong> <strong>the</strong> following courts into<br />

<strong>the</strong> Supreme Court: <strong>the</strong> <strong>New</strong> <strong>York</strong> City Civil and Criminal<br />

<strong>Courts</strong>, <strong>the</strong> Court <strong>of</strong> Claims, <strong>the</strong> Family Court, <strong>the</strong> County Court,<br />

and <strong>the</strong> Surrogate’s Court. 95<br />

In 1976, <strong>the</strong> Legislature gave first passage <strong>of</strong> an<br />

amendment to Article VI <strong>of</strong> <strong>the</strong> <strong>New</strong> <strong>York</strong> <strong>State</strong> C<strong>on</strong>stituti<strong>on</strong> to<br />

provide for <strong>the</strong> following: (1) gubernatorial appointment <strong>of</strong><br />

judges to <strong>the</strong> Court <strong>of</strong> Appeals, (2) centralizati<strong>on</strong> <strong>of</strong> court<br />

administrati<strong>on</strong> under <strong>the</strong> authority <strong>of</strong> <strong>the</strong> Chief Judge and Chief<br />

Administrative Judge, and (3) aboliti<strong>on</strong> <strong>of</strong> <strong>the</strong> Court <strong>on</strong> <strong>the</strong><br />

Judiciary. 96 In 1977, <strong>the</strong>se proposals were given sec<strong>on</strong>d passage<br />

“Expensive and time-c<strong>on</strong>suming<br />

disputes over <strong>the</strong> jurisdicti<strong>on</strong><br />

<strong>of</strong> <strong>the</strong> various courts, and<br />

<strong>the</strong> c<strong>on</strong>stant shuttling <strong>of</strong> <strong>on</strong>e<br />

case between various courts,<br />

will . . . be eliminated by <strong>the</strong><br />

proposed merger.”<br />
