designated as Acting Supreme Court Justices and assigned to <strong>the</strong><br />

Supreme Court <strong>on</strong> a c<strong>on</strong>tinuing basis. 38<br />

Today, 130 — approximately half <strong>of</strong> <strong>the</strong> judges serving in<br />

<strong>the</strong> Supreme Court in <strong>New</strong> <strong>York</strong> City — are Acting Supreme<br />

Court Justices. These judges were not elected to <strong>the</strong> Supreme<br />

Court (or, in many cases, to <strong>the</strong>ir original judgeships) but have<br />

been placed <strong>the</strong>re by <strong>the</strong> Chief Administrative Judge as a<br />

necessary accommodati<strong>on</strong> to <strong>the</strong> c<strong>on</strong>stituti<strong>on</strong>al limitati<strong>on</strong> <strong>on</strong> <strong>the</strong><br />

number <strong>of</strong> Supreme Court Justices. The heavy reliance <strong>on</strong> this<br />

stopgap measure has thinned <strong>the</strong> ranks <strong>of</strong> judges in <strong>the</strong> <strong>New</strong> <strong>York</strong><br />

City Civil and Criminal <strong>Courts</strong> to <strong>the</strong> point where those courts are<br />

chr<strong>on</strong>ically underserved. 39<br />

This c<strong>on</strong>stituti<strong>on</strong>al cap <strong>on</strong> <strong>the</strong> number <strong>of</strong> Supreme Court<br />

Justices, and <strong>the</strong> resulting Acting Supreme Court Justice regime,<br />

is ano<strong>the</strong>r hallmark <strong>of</strong> our inflexible system. (We note that even<br />

opp<strong>on</strong>ents <strong>of</strong> past restructuring proposals have endorsed <strong>the</strong><br />

eliminati<strong>on</strong> <strong>of</strong> this c<strong>on</strong>stituti<strong>on</strong>al restricti<strong>on</strong>. 40 ) In Secti<strong>on</strong> Six <strong>of</strong><br />

this Report, we recommend that <strong>the</strong> c<strong>on</strong>stituti<strong>on</strong>al cap finally be<br />

lifted and <strong>the</strong> system <strong>of</strong> Acting Supreme Court Justices<br />

eventually be eliminated.<br />

The Appellate Divisi<strong>on</strong>:<br />

Overloaded and Unbalanced<br />

The Appellate Divisi<strong>on</strong> <strong>of</strong> <strong>the</strong> Supreme Court is <strong>the</strong><br />

predominant intermediate appellate court <strong>of</strong> <strong>the</strong> state. In some<br />

ways, <strong>the</strong> structure <strong>of</strong> <strong>the</strong> Appellate Divisi<strong>on</strong> is even more<br />

antiquated and outdated than <strong>the</strong> structure <strong>of</strong> <strong>the</strong> trial courts.<br />

The <strong>New</strong> <strong>York</strong> <strong>State</strong> Court <strong>of</strong> Appeals later rejected a legal challenge<br />

to <strong>the</strong>se judicial appointments. See Taylor v. Sise, 33 N.Y.2d 357 (1974).<br />

Outside <strong>New</strong> <strong>York</strong> City, <strong>the</strong>re also has been significant reliance <strong>on</strong><br />

temporary assignments to <strong>the</strong> Supreme Court from am<strong>on</strong>g <strong>the</strong> county-level judges.<br />

The frequency and <strong>of</strong>ten extended durati<strong>on</strong> <strong>of</strong> <strong>the</strong>se assignments has necessitated<br />

a domino-like sec<strong>on</strong>d round <strong>of</strong> temporary assignments to backfill resulting vacancies<br />

<strong>on</strong> <strong>the</strong> county-level courts. These sec<strong>on</strong>dary temporary assignments are filled<br />

through <strong>the</strong> assignment <strong>of</strong> full-time City Court judges to County and Family<br />

<strong>Courts</strong>.<br />
