Secti<strong>on</strong> Two describes <strong>the</strong> harm and frustrati<strong>on</strong> that befall<br />

<strong>the</strong> people and businesses that are forced to use our antiquated<br />

and inefficient court system. These include injured plaintiffs,<br />

victimized children, families in crisis, municipalities, state<br />

agencies, and large and small businesses <strong>of</strong> every sort.<br />

Secti<strong>on</strong> Three sets forth our analysis (an analysis that has<br />

never before been c<strong>on</strong>ducted) <strong>of</strong> <strong>the</strong> fiscal impact that reform<br />

would have <strong>on</strong> businesses, municipalities, state agencies, and<br />

individuals throughout <strong>the</strong> state. It c<strong>on</strong>cludes that, with respect<br />

to productivity, lost wages, attorneys’ fees and related costs, <strong>the</strong><br />

savings amount to $443 milli<strong>on</strong> per year. (Note that this financial<br />

analysis, and its c<strong>on</strong>clusi<strong>on</strong>, have been independently verified by<br />

<strong>the</strong> Nati<strong>on</strong>al Center for <strong>State</strong> <strong>Courts</strong>.) It goes <strong>on</strong> to review <strong>the</strong><br />

additi<strong>on</strong>al $59 milli<strong>on</strong> in savings that might be realized by <strong>the</strong><br />

state through reducti<strong>on</strong>s in administrative costs at OCA, for a<br />

total estimated savings <strong>of</strong> $502 milli<strong>on</strong> per year.<br />

Secti<strong>on</strong> Four provides a brief history <strong>of</strong> past reform<br />

efforts, a history which dates back more than fifty years, and<br />

describes <strong>the</strong> many past and present c<strong>on</strong>stituencies that have<br />

called for reform. This includes a new coaliti<strong>on</strong> <strong>of</strong> business<br />

organizati<strong>on</strong>s from across our state which has announced its<br />

support for “efforts to secure amendment <strong>of</strong> <strong>the</strong> <strong>New</strong> <strong>York</strong> <strong>State</strong><br />

C<strong>on</strong>stituti<strong>on</strong> to create a two-tier court system that will greatly<br />

improve <strong>the</strong> administrati<strong>on</strong> <strong>of</strong> justice and result in significant<br />

savings in time and expense to individuals and business.” Letters<br />

<strong>of</strong> support from this business coaliti<strong>on</strong> and o<strong>the</strong>r prominent<br />

organizati<strong>on</strong>s are included as an appendix to this Report.<br />

Secti<strong>on</strong> Five describes <strong>the</strong> many successful administrative<br />

initiatives that OCA has adopted in <strong>the</strong> past ten<br />

years, including <strong>the</strong> Commercial Divisi<strong>on</strong>, Community <strong>Courts</strong>,<br />

Integrated Domestic Violence <strong>Courts</strong>, and o<strong>the</strong>rs. The success<br />

<strong>of</strong> <strong>the</strong>se initiatives dem<strong>on</strong>strates how effective a broader<br />

c<strong>on</strong>solidati<strong>on</strong> <strong>of</strong> <strong>the</strong> courts could be.<br />

Secti<strong>on</strong> Six sets forth our detailed proposal for reform.<br />

In additi<strong>on</strong> to <strong>the</strong> points outlined above, this includes a discussi<strong>on</strong><br />

<strong>of</strong> <strong>the</strong> types <strong>of</strong> changes that would be required to <strong>the</strong> state’s<br />

procedural codes, and to <strong>the</strong> courts’ computer and o<strong>the</strong>r<br />
