professi<strong>on</strong>al. Two factors stand out as especially relevant. The<br />
first is the c<strong>on</strong>sequences of the refusal to share informati<strong>on</strong>.<br />
There would be a str<strong>on</strong>ger case for overriding individuals’<br />
objecti<strong>on</strong>s where the informati<strong>on</strong> would influence a decisi<strong>on</strong> having<br />
potentially damaging rather than merely inc<strong>on</strong>venient<br />
c<strong>on</strong>sequences for other family members. The sec<strong>on</strong>d is the<br />
reas<strong>on</strong> for the individual’s refusal to give permissi<strong>on</strong>. If it can be<br />
determined that the reas<strong>on</strong>s are malicious, the decisi<strong>on</strong> may be<br />
straightforward. However, if the reas<strong>on</strong> were a fear that the<br />
informati<strong>on</strong> might yield compromising evidence about paternity, the<br />
<str<strong>on</strong>g>ethical</str<strong>on</strong>g> <str<strong>on</strong>g>issues</str<strong>on</strong>g> would be quite different. If informati<strong>on</strong> about n<strong>on</strong>paternity<br />
were not disclosed, a man who incorrectly believed<br />
himself to be the father of a child with a particular genetic status<br />
might make the wr<strong>on</strong>g decisi<strong>on</strong>s about having children. On the<br />
other hand, for the health professi<strong>on</strong>al to reveal such informati<strong>on</strong><br />
might lead to harm to the woman c<strong>on</strong>cerned, not <strong>on</strong>ly because of<br />
the breach of c<strong>on</strong>fidentiality itself, but also because of its impact<br />
<strong>on</strong> the woman’s relati<strong>on</strong>ship with the man involved. For this<br />
dilemma there is no easy answer.<br />
<str<strong>on</strong>g>Genetic</str<strong>on</strong>g> registers<br />
5.32 So far, we have c<strong>on</strong>sidered the c<strong>on</strong>sequences of individual results<br />
and their disclosure. In the c<strong>on</strong>text of genetic <str<strong>on</strong>g>screening</str<strong>on</strong>g>, where<br />
large numbers of tests are being undertaken, this may be<br />
recorded in the form of a genetic register or similar database.<br />
Special c<strong>on</strong>siderati<strong>on</strong> has therefore to be given to the implicati<strong>on</strong>s<br />
for security of these grouped results.<br />
5.33 A register can be defined as a systematic collecti<strong>on</strong> of relevant<br />
informati<strong>on</strong> <strong>on</strong> a group of individuals. <str<strong>on</strong>g>Genetic</str<strong>on</strong>g> registers record<br />
informati<strong>on</strong> <strong>on</strong> individuals with specific genetic disorders, and may<br />
include relatives at risk of developing or transmitting the c<strong>on</strong>diti<strong>on</strong>.<br />
The informati<strong>on</strong> may be recorded by hand, or may be held <strong>on</strong><br />
computer. <str<strong>on</strong>g>Genetic</str<strong>on</strong>g> registers may be set up for a variety of<br />
reas<strong>on</strong>s, including research <strong>on</strong> the disorder, the effective provisi<strong>on</strong><br />
of services to those <strong>on</strong> the register, and the systematic offering of<br />
genetic counselling to family members. The amount and type of<br />
informati<strong>on</strong> recorded also varies greatly, as does the presence of<br />
identifying details.<br />
5.34 A number of general <str<strong>on</strong>g>ethical</str<strong>on</strong>g> <str<strong>on</strong>g>issues</str<strong>on</strong>g> c<strong>on</strong>cerning genetic registers<br />
exist. Here we outline those <str<strong>on</strong>g>issues</str<strong>on</strong>g> relating to genetic <str<strong>on</strong>g>screening</str<strong>on</strong>g>.<br />
They need to be seen against the background of the following<br />
