to the former. <str<strong>on</strong>g>The</str<strong>on</strong>g> other grounds have not been<br />
allowed to proceed, although at the time <str<strong>on</strong>g>of</str<strong>on</strong>g> writing the<br />
BUAV is c<strong>on</strong>sidering appealing against this decisi<strong>on</strong>.††<br />
■ In 2003 the BUAV reported its findings <str<strong>on</strong>g>of</str<strong>on</strong>g> an<br />
undercover investigati<strong>on</strong> undertaken in Germany<br />
within Covance, a CRO. <str<strong>on</strong>g>The</str<strong>on</strong>g> BUAV alleged that Covance<br />
had breached German animal-welfare legislati<strong>on</strong>.<br />
Covance denied the allegati<strong>on</strong>s and an investigati<strong>on</strong><br />
was initiated by the German authorities. All accusati<strong>on</strong>s<br />
were found to be groundless. In July 2004, the BUAV<br />
submitted a complaint to the European Commissi<strong>on</strong><br />
stating that the German authorities had failed to<br />
properly transpose into nati<strong>on</strong>al law the EU Directive<br />
regulating animal experiments. <str<strong>on</strong>g>The</str<strong>on</strong>g> BUAV also asserted<br />
that appropriate sancti<strong>on</strong>s against Covance for<br />
breaches <str<strong>on</strong>g>of</str<strong>on</strong>g> German animal-welfare law had not been<br />
imposed. In refusing Covance’s applicati<strong>on</strong> for an<br />
injuncti<strong>on</strong>, the appeal court in Nordrhein Westfalen<br />
allowed the disseminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> video and photograph<br />
material obtained by the investigator.‡‡<br />

CHAPTER 2 THE CONTEXT OF ANIMAL RESEARCH: PAST AND PRESENT<br />
2.20 Opp<strong>on</strong>ents <str<strong>on</strong>g>of</str<strong>on</strong>g> undercover investigati<strong>on</strong>s view them as unlawful and possibly illegal<br />
infiltrati<strong>on</strong>s. 26 <str<strong>on</strong>g>The</str<strong>on</strong>g>y argue that the investigators provide untruthful informati<strong>on</strong> when applying<br />
for jobs and at interviews, and that they act unlawfully during their time at the instituti<strong>on</strong>, for<br />
example by disclosing c<strong>on</strong>fidential informati<strong>on</strong>. <str<strong>on</strong>g>The</str<strong>on</strong>g>y also argue that many infiltrati<strong>on</strong>s fail to<br />
produce any compromising evidence, and that these findings are not published. Where<br />
findings are published, critics assert that reports are <str<strong>on</strong>g>of</str<strong>on</strong>g>ten highly selective in the facts that are<br />
presented and that they therefore do not do justice to the claim <str<strong>on</strong>g>of</str<strong>on</strong>g> showing the reality <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
animal <str<strong>on</strong>g>research</str<strong>on</strong>g>. Many establishments also have ‘whistleblowing’ procedures in place, that<br />
require staff to report breaches <str<strong>on</strong>g>of</str<strong>on</strong>g> codes <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>duct to supervisors, facility managers or to the<br />

usually not compatible with c<strong>on</strong>tracts <str<strong>on</strong>g>of</str<strong>on</strong>g> employment, breach the civil law. <str<strong>on</strong>g>The</str<strong>on</strong>g> criminal law can be invoked in cases where<br />
employment is obtained by decepti<strong>on</strong> (<str<strong>on</strong>g>The</str<strong>on</strong>g>ft Act 1968 s.16(2)(c)), or in cases where material is removed from laboratories<br />
(<str<strong>on</strong>g>The</str<strong>on</strong>g>ft Act 1968 s.1). An important criteri<strong>on</strong> in deciding about the applicability <str<strong>on</strong>g>of</str<strong>on</strong>g> these <str<strong>on</strong>g>of</str<strong>on</strong>g>fences is ‘dish<strong>on</strong>esty’, which is a<br />
relatively vague c<strong>on</strong>cept relating to whether or not the acti<strong>on</strong> was c<strong>on</strong>trary to accepted standards in society.<br />
