ERP is critically important. Three <str<strong>on</strong>g>of</str<strong>on</strong>g> its most significant functi<strong>on</strong>s are to act as a forum for<br />
discussi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Three Rs, to c<strong>on</strong>sider ethical and regulatory issues raised by animal<br />
<str<strong>on</strong>g>research</str<strong>on</strong>g> and to undertake an initial cost-benefit assessment before a licence applicati<strong>on</strong> is<br />
passed to the institute’s certificate holder.<br />
13.54 As has become clear during the discussi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> members <str<strong>on</strong>g>of</str<strong>on</strong>g> the Working Party and also from<br />
resp<strong>on</strong>ses to our C<strong>on</strong>sultati<strong>on</strong>, views differ <strong>on</strong> whether the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the A(SP)A are<br />
sufficient in scope and detail; whether they are always interpreted correctly; and whether,<br />
in its practical applicati<strong>on</strong>, the legal requirements are always implemented effectively. For<br />
example, resp<strong>on</strong>dents to the C<strong>on</strong>sultati<strong>on</strong> made the following observati<strong>on</strong>s:<br />
‘I’m not sure that present regulati<strong>on</strong>s are appropriate. For <strong>on</strong>e thing how can <str<strong>on</strong>g>research</str<strong>on</strong>g>ers<br />
tell if there will be welfare problems in advance?’<br />
An<strong>on</strong>ymous<br />
‘Current provisi<strong>on</strong>s for the assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> welfare <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>animals</str<strong>on</strong>g> are rigorous and <str<strong>on</strong>g>of</str<strong>on</strong>g> high<br />
quality, but must be c<strong>on</strong>tinuously revised and improved as our knowledge and<br />
understanding increases… Assessments <str<strong>on</strong>g>of</str<strong>on</strong>g> welfare should be c<strong>on</strong>ducted before, during<br />
and after a project.’<br />

‘Although inspecti<strong>on</strong> is important, it is the culture <str<strong>on</strong>g>of</str<strong>on</strong>g> care at a particular establishment<br />
which is paramount. In this regard, the Ethical Review Process mandated by A(SP)A is I<br />
believe unique to UK legislati<strong>on</strong>. <str<strong>on</strong>g>The</str<strong>on</strong>g> Home Office Inspectors play a valuable role in<br />
educati<strong>on</strong> and sharing <str<strong>on</strong>g>of</str<strong>on</strong>g> best practice in this activity.’<br />
An<strong>on</strong>ymous<br />
‘Legal protecti<strong>on</strong> for GM <str<strong>on</strong>g>animals</str<strong>on</strong>g> is inadequate and changes in the law are required in<br />
order to afford them due c<strong>on</strong>siderati<strong>on</strong>. This is, not least, because their use, certainly <strong>on</strong><br />
its current scale, was not foreseen when that legislati<strong>on</strong> was introduced.’<br />

‘<str<strong>on</strong>g>The</str<strong>on</strong>g> current licensing system proscribes everything which is not specifically permitted <strong>on</strong><br />
an individual project basis, rather than legislating what may and may not be d<strong>on</strong>e by<br />
everybody in order to maintain standards <str<strong>on</strong>g>of</str<strong>on</strong>g> welfare. This has generated a vast<br />
bureaucracy which undoubtedly impedes the progress <str<strong>on</strong>g>of</str<strong>on</strong>g> science.’<br />

animal <str<strong>on</strong>g>research</str<strong>on</strong>g> are presented in Chapter 15 (see paragraphs 15.53–15.56 and 15.84–15.87).<br />
So far we have reviewed the wide scope <str<strong>on</strong>g>of</str<strong>on</strong>g> costs and benefits arising from the uses <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
<str<strong>on</strong>g>animals</str<strong>on</strong>g> in different areas (Chapters 4–9), as well as the current state and potential <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />
Three Rs (Chapters 11 and 12) and the regulatory framework. We now c<strong>on</strong>sider how these<br />
findings should be viewed from an ethical perspective.<br />
